P. 90 costs in this behalf expended and that certificates issue directed to the County treasurer of White County &c.
State ) vs Issd. ) Guarnishment Joseph Kittrell senr. ) Whereas by the judgement of this court at the last term the State recover against the defendant for the sum of five dollars for his fine assessed against the defendant, as also the further sum of thirteen dollars and forty cents, for his costs of prosecution for an Assault and battery &c. upon which a writ of fierifacias was issued directed &c. and which was returned endorsed thereon "no property found" and whereas also Henry Lyda was summoned to appear here in Court as a Guarnishee to declare upon his corporal oath what he stood indebted to the said Joseph Kittrell Senr. and what of his effects he had in his hands or what other person to his knowledge, what and how much, And now the said Henry Lyda appeared here in Court and after being sworn in due form of saith that he stands justly indebted to the said Joseph Kittrell Senr in the sum of one dollar and fifty cents and no more and that he does not not know of any other person who stands indebted to said Kittrell or that hath any of his property in their possession Therefore It is considered by the Court that the State recover against the said Henry Lyda the sum of one dollar fifty cents to be applied in discharge of the Judgement aforesaid obtained by this State against the said Joseph Kittrell Senr. at the last term of this court, and It is further considered by the Court that the State recover against said Joseph Kittrell Senr. the costs in this behalf expended &c.
