Het is 9 september 1877, 's avonds omstreeks halfacht. Anna van Zon uit Dongen, dienstbode in het gezin Oomes-Martens, keert terug bij hun huis met een van de kinderen op haar arm. Maria Martens wacht hen op en er ontstaat een woordenwisseling tussen beiden; Maria Martens neemt het kind af en geeft Anna van Zon een klap in het gezicht. De laatste laat dat niet op zich zitten en doet aangifte hiervan en proces-verbaal wordt opgemaakt door de rijksveldwachter Willem Krul. Vervolgens komt het voorval voor op de openbare correctionele terechtzitting van de rechtbank in Breda op 5 november 1877. Twee getuigen: Johanna Tempelaars, oud 17 jaar en Maria Kuppen, oud 17 jaar, beiden dienstbode uit Oosterhout, bevestigen dat zij de klap in het gezicht hebben zien geven. Op de Zitting van 12 november 1877 verklaart de rechter Maria Martens schuldig aan het feit en veroordeelt haar tot een geldboete van 5 gulden en verwijst haar in de proceskosten.
