Bastiaan roept volgens Cornelis op een gegeven moment van boven uit het huis: 'Wil je wel eens weggaan, anders zal ik je den kop van het hoofd hakken'. Bastiaan komt vervolgens naar beneden, haalt een graszeis uit de schuur en slaat Cornelis daarmee in zijn nek. De rechtbank in Den Bosch veroordeelt Bastiaan hiervoor op 30 juli 1902 tot zes maanden gevangenisstraf. Bastiaan zit zijn straf uit in de gevangenis van Breda.
