Op 09-06-1728 koopt hij de molen bij de Vispoort met de woning van zijn dochter en schoonzoon voor 7000 gld. onder de voorwaarde dat zijn schoonzoon Andries zou afzien van het proces.

Uit dit huwelijk:
1. v Margaretha (Margaretha) Hendriks TOP (December), geb. 1705 te ?. Echtgenote van Jan (Jan) Jansz HOEGE. Geb. 1704 te verm. Terwolde z.v. Jan (Jan) Harmsz HOEGE en Willempje (Willempje) Gerrits. De doop van Jan is niet gevonden onduidelijk waar de aaname voor deze ouders vandaan is gekomen. Otr. op 26-02-1730 te Elburg, tr. op 19-03-1730 te Elburg, tr. kerk op 19-03-1730 te Elburg.
2. v Dina (Dina) Hendriks. Geb. ? te Elburg. Otr. op 02-06-1715 te Elburg, tr. op 23-06-1715 te Doornspijk. Echtgenoot is Andries (Andries) Jansz WALLERT [16293], papiermolenaar.
Geb. 08-1691 te ?, ged. (NG) op 30-08-1691 te Elburg. Z.v. Jan (Jan) Elbertsz WALLERT en Ariaantje (Ariaantje) Andries van EMST.
Rond 1717 heeft Andries geld geleend van de ouders van Dina om de molen te kunnen bouwen. Er werden verschillende soorten papier gemaakt maar niet de beste kwaliteit papier. Al gauw kreeg Andries nog meer schuld. Hij voerde een proces met zijn neef Engelbert Haack, die papier voor hem verkocht in Amsterdam en die hij nog ruim 3300 gld. schuldig was. Op 8-4-1724 werd Andries veroordeeld tot het betalen van zijn schuld. Andries ging door met proces voeren om de zaak te rekken. ZIjn schoonvader Hendrik verhinderde dit echter.
