Notes about Nicholas BARHAM

On 27 & 28 Feb 1755 William Moreland of Court Lodge in Lamberhurst, Kent, esq, with his trustee Alexander Courthope of Sprivers in Horsmonden, Kent, sold for £30 to NICHOLAS BARHAM of Wadhurst, wheelwright, a property described as a piece of land
(1a) being the upper corner of a field called Great Sparrows, part of Westons Farm in Wadhurst, formerly occupied by John Wood and now by John Elliott, the residue of the field having been sold by Moreland on 25 & 26 Feb 1755 to Richard Tapsell of Wadhurst, gent

The deed contained a covenant by Moreland to pay an annuity of £70 due to Dame Elizabeth Chaplin, which had been charged on the land by deeds of 17 & 18 Jun 1740 (1-2) BARHAM mortgaged the premises for £90 on 18 Jul 1769 to John Newington of High Town in Wadhurst, gent.

In his will of 7 Jul 1778 Newington appointed Jeremiah Curteis of Rye, gent, and Robert Noakes of High Town in Wadhurst, gent, as his executors; Newington died in 1780 and his will was proved in the PCC on 17 May 1780. On 26 Jul 1787 Newington's executors assigned the mortgage, (on which interest of £22 was outstanding), to John Newington of High Town in Wadhurst (great-nephew of JN) as his share of the residue of the personal estate.

BARHAM died intestate in 1790 and letters of administration were granted to his son THOMAS BARHAM of Wadhurst, wheelwright, on 14 Jun 1790 [SM/D10.112]. On 20 & 21 Aug 1792 he sold the property, then described a piece of land on which a messuage had been lately erected, for £135 to his brother NICHOLAS BARHAM of Wadhurst, wheelwright and on the same day entered into a bond for £100 to indemnify NICHOLAS BARHAM against any claim to dower by THOMAS BARHAM's wife, JEMIMA BARHAM redeemed the mortgage on 1 Jan 1793 but the term for 1000 years was not surrendered.

NICHOLAS in his will and codicil of 5 Jun and 9 Jun 1807 appointed William Moreland of Wadhurst, farmer and Thomas Wallis of Wadhurst, shopkeeper as his executors, who were to hold his real estate in trust for his five children (NICHOLAS, PHYLIS, EASTMUND, MARY and TALLIFICUMI BARHAM) as tenants in common until the youngest of them should reach the age of 21 years. The will was proved at South Malling on 11 Dec 1807.
