    William DAVIS, John BROWN and Elizabeth his wife, Martha DAVIS and Merritt DAVIS of the County of Brunswick, State of Virginia, Benjamin DAVIS of Oglethorpe County, State of Georgia, Peter RAGSDALE of Bedford County, State of Tennessee, as attorney in fact for Thomas DAVIS and Henry DAVIS of the County of Bedford, State of Tennessee, and as attorney in fact for John DAVIS of the County of Robertson, state of Tennessee, of one part, and Nicholas E. LEWIS, of the other part, witnesseth:
    Whereas, Benjamin DAVIS, deceased, by his last will and testament bequeathed his lands to be divided equally between all of his children.

    5. Benjamin DAVIS of Brunswick Co., VA, Planter, son of Henry and Mary Marriott DAVIS, married Tabitha, daughter of John ROSE of Brunswick Co., VA, Planter. The second of their seven sons was also named Benjamin. Tabitha Rose DAVIS died bef. 1810 and her husband in Apr 1817.

    He seems to have removed permanently to Brunswick Co. after his father’s death in 1767, having purchased a small plan- (cont. pg 257)tation there in 1770 and being executor of the will of his brother William DAVIS of Brunswick two years later. In 1775 he and his brother Randolph were witnesses to the marriage bond of Elizabeth DAVIS, their sister, to John ROSE, Jr., brother of Tabitha, wife of Benjamin DAVIS. By a deed dated 20 May 1777, Benjamin DAVIS sold the above mentioned land and was joined in its execution by his wife, Tabitha , evidencing that they were married before that date. In 1792 he was executor of the will of John ROSE, Jr.

    By his will dated 07 Aug 1780, John ROSE, Sr. of the County of Brunswick and Parish of St. Andrew, Planter, named his son, John ROSE, Jr. as residuary legatee and executor and bequeathed “unto my daughter Tabitha DAVIS...the Plantation on which she and her husband now live...”.

    Apparently, Tabitha ROSE DAVIS died prior to 1810 as she was not included as a member of Benjamin DAVIS’ household in the US Census of that year. Benj. DAVIS acquired substantial holdings of land and slaves during his residence in Brunswick, and he died there between 9 Apr, the date the Will was written, and 28 Apr 1817, the date is was probated. His surviving children, as named in his will and in several subsequent powers of attorney and land deeds incident to the settlement of his estate, were William, Elizabeth (wife of John BROWN), John, Martha (wife of Littleberry BAUGH), Benjamin, Henry, Thomas, and Merritt DAVIS. (6T 110).

    As set forth in the minutes of a Brunswick Co. Court held on 23 Apr 1783, Benjamin DAVIS gave aid to the American Revolution by furnishing supplies. In an account of the DAVIS family, he is referred to as “Major Benjamin DAVIS who lived in Brunswick Co., VA, and was an Officer in the Revolution”. His name is also included in a list of Revolutionary War officers published in Vol. VI of the Alabama Historical Quarterly. No confirmation of this service has been found in the VA records but teh family tradition is strong and it is probably that Benj. DAVIS was an officer of the GA Militia during the early years of the war. It must certainly be more than mere coincidence that after selling the only land he is known to have ownd in 1777, he is not mentioned again in the Brunswick records until 1780; that he had a brother, Randolph, and that men named Benjamin and Randolph DAVIS appear in the Georgia Certified List of Revolutionary Soldiers; that a Benjamin DAVIS applied for by proxy and was granted land in Georgia in 1784 as a refugee soldier entitled to a bounty; and that in 1809 Benjamin DAVIS, Jr., son of Benjamin DAVIS of Brunswick, sold a portion of what seems to have been the same tract of land.

    6. Benjamin DAVIS of Autauga Co., AL, Planter and Merchant, son of Benjamin and Tabitha ROSE DAVIS, was born on 25 Apr 1784. He was married in 1816 to Martha, dau. of Benj. TAYLOR of Oglethorpe Co., GA, Planter. Their fourth child and second daughter was Louisiana Caroline DAVIS. Benjamin DAVIS died in Autauga Co. on 23 Jun 1863 and his wife died there in Sep 1873.

    Benjamin DAVIS removed as a young man to Oglethorpe Co., GA and served as 1st Lt. in the GA Militia during the War of 1812. He was usually referred to as “Major” but it is unknown whether this was a courtesy title or arose from service.

    “State of Alabama, Autauga Co. The 24th of Aug, Anno Domini, one thousand eight hundred and fifty five: Personally appeared before me, Thos. C. MONROE, J.P. within and for the County and STate aforesaid, Benjamin DAVIS, aged seventy years, a resident of Autauga Co. in the State of Alabama, who, being duly sworn according to Law, declares that he is the identical Benjamin DAVIS who was a First Lietenant in the Company commanded by Capt. Burwell POPE, in the Regiment of Militia commanded by Col. Jett THOMAS, in the War with Britain declared by the U.S. on 18 Jun 1812...
    He makes this declaration for the purpose of obtaining bounty and to which he may be entitled under the Act approved the 3rd day of Mar 1855. Signed Benjamin DAVIS.”

    In 1818, Major DAVIS and his wife, Martha TAYLOR DAVIS, moved from GA to AL, settling first in Shelby and later moving to Autauga Co. He was appointed Justice of the Peace 20 Nov 1818 and he and his father-in-law Benj. TAYLOR, are shown by the census records as residents of Shelby in 1820 and in Autauga in 1830 and thereafter.

Son of Maj. Benj and Tabitha DAVIS who lived in Brunswick Co., VA. ... He was a Democrat and a Methodist,...m. 28 May 1816 to Martha, dau. of Benj. TAYLOR who came to AL from GA. She died in 1873 age 77 yrs. Children: Mary Elizabeth m. Cary L. NEWMAN; Merrit Warren, killed at 9 yrs by falling tree; Benjamin F., M.D., m. Elizabeth FRITH; Louisiana Carline m. John H. BARLOW; Thomas Asbury, physician, served in teh C.S. Army as Capt. of Co. G, then as Surgeon, later as Brigade Surgeon, m. Dora MOTLEY; Robert Henry, died at 21 yrs.; Martha Aurelia m. George W. ZEIGLER; John Williams, physician,m. Astoria SHACKLEFORD.
