Notizen bei Tabitha ROSE

The history and genealogy of the DAVIS and ROSE families of Surry Co., VA appears to have been well researched and documented by several people, but most authoritatively by John Bennet BODDIE, noted Virginia Southside genealogist.

Some records online (including some submitted to the LDS and available on Family Search.org) erroneously state that Tabitha ROSE married Maj. Benjamin DAVIS in Oglethorpe Co., GA where they lived and died. Some even state the couple went on to Autauga, AL. However, Benjamin DAVIS and spouse Tabitha lived in Brunswick Co., VA where he left a will in 1817 and the estate was settled not naming Tabitha who predeceased him.

Son Benjamin DAVIS is the man who went first to Georgia and then Alabama. His full name was apparently Benjamin Franklin DAVIS. The name ran in family, as another of Tabitha’s sons - Henry DAVIS, who moved to Bedford Co., TN, had a grandson named Benjamin F. DAVIS (through his only son John Sims DAVIS).

    5. Benjamin DAVIS of Brunswick Co., VA, Planter, son of Henry and Mary Marriott DAVIS, married Tabitha, daughter of John ROSE of Brunswick Co., VA, Planter. The second of their seven sons was also named Benjamin. Tabitha Rose DAVIS died bef. 1810 and her husband in Apr 1817.

He seems to have removed permanently to Brunswick Co. after his father’s death in 1767, having purchased a small plan- (cont. pg 257)tation there in 1770 and being executor of the will of his brother William DAVIS of Brunswick two years later. In 1775 he and his brother Randolph were witnesses to the marriage bond of Elizabeth DAVIS, their sister, to John ROSE, Jr., brother of Tabitha, wife of Benjamin DAVIS. By a deed dated 20 May 1777, Benjamin DAVIS sold the above mentioned land and was joined in its execution by his wife, Tabitha , evidencing that they were married before that date. In 1792 he was executor of the will of John ROSE, Jr.

By his will dated 07 Aug 1780, John ROSE, Sr. of the County of Brunswick and Parish of St. Andrew, Planter, named his son, John ROSE, Jr. as residuary legatee and executor and bequeathed “unto my daughter Tabitha DAVIS...the Plantation on which she and her husband now live...”.

Apparently, Tabitha ROSE DAVIS died prior to 1810 as she was not included as a member of Benjamin DAVIS’ household in the US Census of that year. Benj. DAVIS acquired substantial holdings of land and slaves during his residence in Brunswick, and he died there between 9 Apr, the date the Will was written, and 28 Apr 1817, the date is was probated. His surviving children, as named in his will and in several subsequent powers of attorney and land deeds incident to the settlement of his estate, were William, Elizabeth (wife of John BROWN), John, Martha (wife of Littleberry BAUGH), Benjamin, Henry, Thomas, and Merritt DAVIS. (6T 110).

As set forth in the minutes of a Brunswick Co. Court held on 23 Apr 1783, Benjamin DAVIS gave aid to the American Revolution by furnishing supplies. In an account of the DAVIS family, he is referred to as “Major Benjamin DAVIS who lived in Brunswick Co., VA, and was an Officer in the Revolution”. His name is also included in a list of Revolutionary War officers published in Vol. VI of the Alabama Historical Quarterly. No confirmation of this service has been found in the VA records but teh family tradition is strong and it is probably that Benj. DAVIS was an officer of the GA Militia during the early years of the war. It must certainly be more than mere coincidence that after selling the only land he is known to have ownd in 1777, he is not mentioned again in the Brunswick records until 1780; that he had a brother, Randolph, and that men named Benjamin and Randolph DAVIS appear in the Georgia Certified List of Revolutionary Soldiers; that a Benjamin DAVIS applied for by proxy and was granted land in Georgia in 1784 as a refugee soldier entitled to a bounty; and that in 1809 Benjamin DAVIS, Jr., son of Benjamin DAVIS of Brunswick, sold a portion of what seems to have been the same tract of land.

    6. Benjamin DAVIS of Autauga Co., AL, Planter and Merchant, son of Benjamin and Tabitha ROSE DAVIS, was born on 25 Apr 1784. He was married in 1816 to Martha, dau. of Benj. TAYLOR of Oglethorpe Co., GA, Planter. Their fourth child and second daughter was Louisiana Caroline DAVIS. Benjamin DAVIS died in Autauga Co. on 23 Jun 1863 and his wife died there in Sep 1873.

Benjamin DAVIS removed as a young man to Oglethorpe Co., GA and served as 1st Lt. in the GA Militia during the War of 1812. He was usually referred to as “Major” but it is unknown whether this was a courtesy title or arose from service.

“State of Alabama, Autauga Co. The 24th of Aug, Anno Domini, one thousand eight hundred and fifty five: Personally appeared before me, Thos. C. MONROE, J.P. within and for the County and STate aforesaid, Benjamin DAVIS, aged seventy years, a resident of Autauga Co. in the State of Alabama, who, being duly sworn according to Law, declares that he is the identical Benjamin DAVIS who was a First Lietenant in the Company commanded by Capt. Burwell POPE, in the Regiment of Militia commanded by Col. Jett THOMAS, in the War with Britain declared by the U.S. on 18 Jun 1812...
He makes this declaration for the purpose of obtaining bounty and to which he may be entitled under the Act approved the 3rd day of Mar 1855. Signed Benjamin DAVIS.”

In 1818, Major DAVIS and his wife, Martha TAYLOR DAVIS, moved from GA to AL, settling first in Shelby and later moving to Autauga Co. He was appointed Justice of the Peace 20 Nov 1818 and he and his father-in-law Benj. TAYLOR, are shown by the census records as residents of Shelby in 1820 and in Autauga in 1830 and thereafter.

From an account of the DAVIS family in Vol. III of Dr. Thomas MCADORY OWEN’s Dictionary of Alabama Biography: DAVIS, BENJAMIN, planter and merchant was b. 25 Apr 1780 in Brunswick Co., VA and died 29 Jun 1863 in Autauga Co., AL. Son of Maj. Benj and Tabitha DAVIS who lived in Brunswick Co., VA. ... He was a Democrat and a Methodist,...m. 28 May 1816 to Martha, dau. of Benj. TAYLOR who came to AL from GA. She died in 1873 age 77 yrs. Children: Mary Elizabeth m. Cary L. NEWMAN; Merrit Warren, killed at 9 yrs by falling tree; Benjamin F., M.D., m. Elizabeth FRITH; Louisiana Carline m. John H. BARLOW; Thomas Asbury, physician, served in teh C.S. Army as Capt. of Co. G, then as Surgeon, later as Brigade Surgeon, m. Dora MOTLEY; Robert Henry, died at 21 yrs.; Martha Aurelia m. George W. ZEIGLER; John Williams, physician,m. Astoria SHACKLEFORD.

Thomas DAVIS was in the Surry Co. Militia in 1687 and appears as a tithable in 1688. In 1694 he had James ROBINSON in his household. In 1702 he had four tithables: himself, and Mingo, Jack and Peg, negroes. (Col. Surry) On 03 Mar 1689/90 he bought fifty acres from Adam HEATH and his wife Sarah, which land HEATH had purchased from Samuel THOMPSON. (DB4 P159).

On 11 Mar 1703/04 he made a deed of gift of a negro boy named Will to his grandson Mathew ELLIS, son of Elizabeth Davis ELLIS and James ELLIS. (DB 1694-1709, Part 2- 297). He then bought 150 acres in Surry from Wm. RHODES and Susanna, his wife, on 17 May 1706 for 5000 lbs of tobacco. (DB 1694-1709, part 2 -349). He made his Will on 28 Sep 1716, probabted 21 Dec 1720. He gave son JAMES DAVIS all land and houses he possessed, wife to have use of same for life; legacies to grandson Mathew ELLIS and Thomas ELLIS; granddaughters Elizabeth and Isabel ELLIS; grandchildren: Thomas DAVIS, negro boy Roger; Jane DAVIS, negro girl Betty; James DAVIS, negro boy Mingo; Henry DAVIS, negro girl Peg; Elizabeth ELLIS, a good Bible; son James DAVIS, negro wench Sarah. Wits: Samuel THOMPSON, Thomas KING, Zachariah MADDERRA. (Wills & Deeds 1715-30, pg 287)

James DAVIS, son of Thomas and Elizabeth DAVIS, on 16 FEb 1722 received a grant of 330 acres in Surry next to Capt. Henry HARRISON. 100 acres were for importing his father and mother many years before, and the balance for 25 shillings. (P.B. II, 1719-1724, p. 193). Inasmuch as his father had been living in Surry for nearly 40 years, this grant must have been for a return trip from England.

James DAVIS married Elizabeth WARREN, daughter of Elizabeth and Thomas WARREN II. His son James was mentioned a ‘grandson’ in the will of Mrs. Elizabeth WARREN, dated 1724, recorded in 1730. Some authorities claim it was he and not his son who was the “James DAVIS” mentioned in the will of Mrs. WARREN; that “James” was the only son of the above Thomas

had, whereas this James, the son of the subject of the this sketch, had several brothers and sisters. Others claim that Thomas WARREN II who was b. 09 Jan 1659/69 (47V329), was of the same generation as Thomas DAVIS, who first appeared as a tithable in 1674 at the age of 16, showing that he was born in 1658. (Col. Surry p. 185) Thomas DAVIS had two sets of grandchildren when he made his will in 1716. It does seem somewhat improbable that his wife could have been a daughter of Thomas WARREN II, inasmuch as he, Thos. DAVIS, was aged enough to mention several grandchildren in his will. (There were several distinct families of DAVIS in Surry and Isle of Wight in the 18th C.)

James DAVIS, Sr. made his will 04 Sep 1746, witnessed by Thomas WARREN, John WARREN and John SLATE, recorded 21 Jan 1746/47. (Will Book 3, pg 546)
Children of James DAVIS d. 1746 were:
    1. Thomas DAVIS (d. 1748) of Isle of Wight Co., VA
    2. Jane DAVIS who m. a WARREN
    3. John DAVIS (of Brunswick Co., VA ?)
    4. James DAVIS (d. 1783) of Surry Co., VA; m. Elizabeth BALDWIN, dau. of William BALDWIN (see later)
    5. Henry DAVIS (d. 1767), of Surry Co., VA m. Mary MARRIOTT, dau. of Wm. MARRIOTT and Sarah (COLLIER) MARRIOTT.
    6. Robert DAVIS (d. 1749) of Pasquotank, NC; m. Sarah [CHAPMAN?]
    7. Nathaniel DAVIS (d. 17__) of Hyde Co., NC
    8. Anne DAVIS m. ca 1740, James NICHOLSON (d. 1793) and had James NICHOLSON who m. Elizabeth WOODRUFF

Henry DAVIS m. Mary MARRIOTT, dau. of Wm. MARRIOTT who was the son of Mathias MARRIOTT and his wife Alice WARREN, daughter of Thomas WARREN.

Henry DAVIS made his will 18 Feb 1767, probated 17 Mar 1767. In it he referred “all that is due me from the estate of William MARRIOTT”. He gave legacies to his children: William, Ann, Hannah, Benjamin, Isham, Randolph, Elizabeth, Henry, Kezia, Marriott, Silvia, and James DAVIS., who were listed in that order. His brother James and his son Benjamin were Executors. (B.K. 1754-68, p. 448)
