Thomas DAVIS was in the Surry Co. Militia in 1687 and appears as a tithable in 1688. In 1694 he had James ROBINSON in his household. In 1702 he had four tithables: himself, and Mingo, Jack and Peg, negroes. (Col. Surry) On 03 Mar 1689/90 he bought fifty acres from Adam HEATH and his wife Sarah, which land HEATH had purchased from Samuel THOMPSON. (DB4 P159).
On 11 Mar 1703/04 he made a deed of gift of a negro boy named Will to his grandson Mathew ELLIS, son of Elizabeth Davis ELLIS and James ELLIS. (DB 1694-1709, Part 2- 297). He then bought 150 acres in Surry from Wm. RHODES and Susanna, his wife, on 17 May 1706 for 5000 lbs of tobacco. (DB 1694-1709, part 2 -349). He made his Will on 28 Sep 1716, probabted 21 Dec 1720. He gave son JAMES DAVIS all land and houses he possessed, wife to have use of same for life; legacies to grandson Mathew ELLIS and Thomas ELLIS; granddaughters Elizabeth and Isabel ELLIS; grandchildren: Thomas DAVIS, negro boy Roger; Jane DAVIS, negro girl Betty; James DAVIS, negro boy Mingo; Henry DAVIS, negro girl Peg; Elizabeth ELLIS, a good Bible; son James DAVIS, negro wench Sarah. Wits: Samuel THOMPSON, Thomas KING, Zachariah MADDERRA. (Wills & Deeds 1715-30, pg 287)
James DAVIS, son of Thomas and Elizabeth DAVIS, on 16 FEb 1722 received a grant of 330 acres in Surry next to Capt. Henry HARRISON. 100 acres were for importing his father and mother many years before, and the balance for 25 shillings. (P.B. II, 1719-1724, p. 193). Inasmuch as his father had been living in Surry for nearly 40 years, this grant must have been for a return trip from England.
James DAVIS married Elizabeth WARREN, daughter of Elizabeth and Thomas WARREN II. His son James was mentioned a ‘grandson’ in the will of Mrs. Elizabeth WARREN, dated 1724, recorded in 1730. Some authorities claim it was he and not his son who was the “James DAVIS” mentioned in the will of Mrs. WARREN; that “James” was the only son of the above Thomas

had, whereas this James, the son of the subject of the this sketch, had several brothers and sisters. Others claim that Thomas WARREN II who was b. 09 Jan 1659/69 (47V329), was of the same generation as Thomas DAVIS, who first appeared as a tithable in 1674 at the age of 16, showing that he was born in 1658. (Col. Surry p. 185) Thomas DAVIS had two sets of grandchildren when he made his will in 1716. It does seem somewhat improbable that his wife could have been a daughter of Thomas WARREN II, inasmuch as he, Thos. DAVIS, was aged enough to mention several grandchildren in his will. (There were several distinct families of DAVIS in Surry and Isle of Wight in the 18th C.)
James DAVIS, Sr. made his will 04 Sep 1746, witnessed by Thomas WARREN, John WARREN and John SLATE, recorded 21 Jan 1746/47. (Will Book 3, pg 546)

Henry DAVIS m. Mary MARRIOTT, dau. of Wm. MARRIOTT who was the son of Mathias MARRIOTT and his wife Alice WARREN, daughter of Thomas WARREN.
Henry DAVIS made his will 18 Feb 1767, probated 17 Mar 1767. In it he referred “all that is due me from the estate of William MARRIOTT”. He gave legacies to his children: William, Ann, Hannah, Benjamin, Isham, Randolph, Elizabeth, Henry, Kezia, Marriott, Silvia, and James DAVIS., who were listed in that order. His brother James and his son Benjamin were Executors. (B.K. 1754-68, p. 448)

‘sick in body’
To my wife Martha – the use of my land while she is single until my son John DAVIS is age 21 & then I lend to her half of my said land during her life or widowhood; also lend to her Negroes Jo & James during her life or widowhood & then they to be sold & the money divided among my children.
To my son John – half my land when he is age 21 & after the death or marriage of my wife I give him the other half of my land; also Negro girl Tab at age 21.
To my daughter Nancy DAVIS – Negro girl Grace at age 18.
To my daughter Mary DAVIS – Negro girl Dinah at age 18.
The residue of my estate after my debts are paid I lend to my wife during her life or widowhood.
I appoint my wife Martha DAVIS guardian to my 3 children, namely, John, Nancy & Mary.
Other provisions.
Ex: my wife, my brother Benjamin DAVIS.
