Toliver Wallace was born in North Carolina, probably Rutherford County. His parents are believed to have been James Wallace (born 1784) and Martha (Patsy) Eaves; however, no documentation has been found to substantiate this. A James Wallace, age 76, was living in Toliver's household at the time of the 1860 U. S. Census for Rutherford County, NC.Rutherford County, NC Record of Estates, Re-A, page 393: June 10-11, 1839 - Toliver Wallace was a purchaser at the estate sale of T. F. Birchett deceased. [Bulletin of the Genealogical Society of Old Tryon County, May 2000, p 89.]Rutherford County, NC Record of Estates, Re-B, page 66: Spring 1841 - In the list of notes due to the estate of Lawson Eaves, Toliver Wallis' note is listed as Doubtful. [Bulletin of the Genealogical Society of Old Tryon County, November 2006, p 179.]Rutherford County, NC Record of Estates, Re-B, page 72: Spring 1841 - James Wallis and Toliver Wallis were purchasers at the estate sale of Lawson Eaves deceased. [Bulletin of the Genealogical Society of Old Tryon County, November 2006, p 179.]From the Rutherford County, NC Estates, Orphans and Others as reported in the Bulletin of the Genealogical Society of Old Tryon County, November 2006, pages 162-163:Summer 1843. " Francis M McClure aged about fifteen years was bound to Toliver Wallis until he attains the age of twenty one years. Wallis agrees to learn said apprentice the art and mystery of a brick mason to give him twelve months schooling and two good suits of clothes extra of his freedom dues said Wallis entered into bond to North Carolina in the sum of two hundred fifty dollars conditioned not to remove or cause or suffer his said apprentice to be removed or carried beyond the limits of Rutherford County and to deliver him up to the county court of Rutherford whenever he shall arrive at the age of freedom or at any time previous thereto if required. The said F. M. McClure was heretofore bound to James V. Jay who delivered him up to court and was released from his indenture." "Ordered by court that a notice issue to Toliver Wallis returnable to next probate court to shew cause if any he can why he shall not surrender to the court Francis M. McClure who was bound to him at this term that the said Francis may otherwise be dealt with as the court may direct." September 1843 - "Ordered by court that the indenture of F. M. McClure to Toliver Wallis be rescinded and that the said McClure be and remain no longer in the possession of the said Wallis or under his control. The court further states that the said McClure be delivered to James V. Jay and that he remain in his possession." Fall 1843 - "Francis M. McClure was bound by indenture to Toliver Wallis until he attains the age of twenty one years (being fourteen years old the 19th of October 1843) said Wallis agreeing to give his apprentice at freedom two good suits of clothes extra of his freedom dues a horse extra fifty dollars - to learn him to read and write and to learn him the art and mystery of a mason ...".During the time he lived in Rutherford County, NC, Toliver Wallace was a brick mason. After moving to Marietta, Cobb County, GA his occupation was farming. It is believed he came to Cobb County after the end of the WBTS. His brother, H B Wallace, had come to Cobb County after he married Martha Johnson on 20 Oct 1845 in Rutherford County, NC and prior to the 1850 U. S. Census for Cobb County. There are no Wallaces/Wallises listed in the 1840 U.S. Census for Cobb County.Toliver's arrival in Cobb County is estimated as 1866-1867. He is listed in the "Index to Georgia's 1867-1868 Returns of Qualified Voters and Registration Oath Books (white)": Vol 115, p 32 and Vol 205, p 195. Compiled by John David Brandenburg and Rita Binkley Worthy. He signed the Oath of Allegiance on 12 July 1867.Several of his children came to Cobb County at approximately the same time based on census records: Wade Hill, Martha Ann, Urcilla, Toliver Watson and Calvin. These children raised families and lived the rest of their lives in Cobb County. Toliver's son William Lafette migrated to AL. His son Calvin moved from GA to TX in 1884. Information is being sought for Arminta, James and Marcus.Harry L Wallace, great-grandson of Wade Hill Wallace (third son of Toliver and Nancy), states in his manuscript titled "The Wallaces - Six Generations, Marietta, Georgia 1844-2003" that Toliver's property was located where the present day Austin Avenue runs northeast to meet North Cobb Parkway. On the old home site is now the New Life Family Church which faces Austin Avenue, slightly north of a creek. Harry's father, Harold E Wallace, said that Toliver was a short man with bushy eyebrows and a wiry build. He wore an old slouch hat and rode a mule wherever he went.On 27 Sep 1873, property owned by Toliver Wallace in Rutherford County, NC was sold at auction by the sheriff to John Allen who assigned the bid to Thomas Miller for $20.00. The description of the property was: "bounded as follows on the waters of Glaghorn Creek [probably the present Cleghorn Creek] joining lands with Mrs. Mooney Mrs. Washburn and the Walton Lands containing ten acres" (Deed Book 51 Page 156). This is the only deed in his name in both Rutherford County, NC and in both Rutherford County, NC and Cobb County, GA. It appears he lived on land owned by others.His obituary appeared in the January 19, 1882 issue of the Marietta Journal:"Died – Mr. Tolliver Wallis, an aged and worthy citizen, died at his home on last Sunday morning. One by one our oldest citizens are passing away." The location of his grave has not been found. He may have been buried on his property. The date of death and burial place of his wife Nancy are not presently known.
