He obtained a "separation from bed and board" in 1663 on grounds of her «u»adultery «/u», and private Acts of Parliament in 1667 bastardizing her issue since 1659 and granting him permissionto remarry in 1670. This process required considerable expenditure and trouble.

Lord Roos succeeded his fatheras «u»Lord Lieutenant of Leicestershire «/u» in 1677, and proved an effective deputy of the crown. His invitation to «u»Lord Sherard «/u» to stand with him for Leicestershire instead of a gentry candidate upset the Leicestershire gentry, and the Commons disallowed Roos' election. He was created «u»Baron Manners of Haddon «/u» on «u»30 April «/u» «u»1679 «/u» and sent to the «u»House of Lords «/u» instead, but succeeded as «u»Earl of Rutland «/u» on «u»29 September «/u» «u»1679 «/u» at the death of his father. He retained his lord lieutenancy in «u»1681 «/u», despite supporting the «u»Exclusion Bill «/u», but was turned out by «u»James II «/u» in 1687.
