    In het jaar 1759 keert hij terug, wordt gegrepen en opgesloten in het kasteel van Amstenrade. Willem sterft 67 jaar oud in 1757 in de kerker van kasteel Amstenrade. Het vonnis luidt dat hij door de vilder onder de galg begraven dient te worden en aldus geschiedt. De familie komt in het geweer tegen dit vonnis dat voor de hele familie oneervol is. Ze gaan in beroep bij de Soevereine Raad van Brabant in Brussel en daar worden zij door de uitspraak van 17 nov. 1760 in het gelijk gesteld. Het lichaam van de Gavarelle wordt uit het schandelijke graf gehaald en hij krijgt een christelijke begrafenis op het kerkhof van Amstenrade.
