He assumed STUART after that of CONSTABLE-MAXWELL 1876. After the death of the last Earl of Traquair, the earldom became extinct as the title could only pass through a male heir. Traquair was then passed to the nearest cousin, Henry Constable Maxwell of Terregles. He added the name Stuart to his own.
