Contract for Property

This Agreement made this Twenty third day of October Nineteen Hundred and Twenty between Irving Comes, of the town of Litchfield, Herkimer County, New York of the first part, and
Addison F. Comes and Herbert I. Comes, of the same place, of the second part, in the manner following: - The said parties have and hereby do mutually covenant and agree as follows: The party of the first part to sell, and the party of the second part to purchase all that tract or parcel of land situate in the Town of Litchfield, County of Herkimer, N.Y., briefly as follows._:Being the farm of the party of the first part situated in said town of Litchfield containing 149 (crossed out and 147 substituted) acres of land be the same more or less. Said farm is described in two certain deeds, the one dated February 19, 1897, and recorded in Herkimer County Clerk's Office .June 26th 1897 in Liber No. 159 of Deeds at page 495; the other of said deeds being dated May 8th 1913 and recorded in said Clerk's Office May 16th 1916 in Liber No. 229 of Deeds at page 247 (crossed out and 243 substituted). There is also hereby conveyed all the farming implements, hay, grain and all crops now
growing on said farm, cows, horses harnesses, wagons and household furniture and utensils.
for the sum of Eight thousand five hundred ($8500.00) Dollars, which sum the said parties of the second part hereby agree to pay to the party of the first part, as follows: One half of all cheese or milk checks for the of sale of cheese or milk and one half of all other income derived from the dairy to be kept on said farm, until the whole of said sum of $8500., and interest thereon shall be fully paid. The parties of the second part hereby agree to keep on said farm at all times at least eighteen head of milch cows. Also to provide on said farm a home for their sister Dorothy Comes so long as she remains single.No interest to be charged on this contract for the first two years.

Said parties of the second part also agree to pay ALL Taxes and Assessments which shall be taxed or assessed upon said premises from the date hereof until said sum shall be fully paid as aforesaid.

And the said party of the first part, on receiving such payment at the time and in the manner
above mentioned, shall, at his own proper cost and expense, execute and deliver to the said parties of the second part, or to their assigns, a good and sufficient Warranty Deed of said premises.

It is agreed that the parties of the second part shall have possession of said premises from and after November 1st 1920.


And it is agreed that the stipulations aforesaid are to apply to and bind the heirs, executors, administrators and assigns of the respective parties.
