My great-great grandparents, Toliver Wallace and Nancy Dycus were living in Rutherford County, North Carolina (RCNC) at the time of their marriage in 1833. Based on their ages in the 1850 Federal Census, Broad River District, RCNC, they were born circa 1809. They had nine known children, all born in NC: Arminta born ca 1835; James ca 1836; William Lafayette 1837; Wade Hill 1843; Martha Ann 1844; Marcus ca 1845; Ursilla 1846; Toliver Watson ca 1848; and Calvin Webb 1850. Toliver Watson Wallace was my great-grandfather.
The earliest official record found to date for the elder Toliver Wallace is from the May 1829 RCNC Road Docket. He was assigned to Jesse Braddy, overseer of the road from Wm. Arthur’s to the fork of the Lincoln Road (Bulletin of the Genealogical Society of Old Tryon County [BGSOTC], May 2007, p 52). In May 1830, Toliver Wallis was appointed to work on the road from Rutherfordton to the fork below A. Eaves's under Spenser Eaves, overseer. (RCNC Road Docket - 1830 - published in the BGSOTC, August 2007, p 108). In June 1831, he was appointed to work on the road from Rutherfordton to the forks below A. Eaves's with Isaham Wood, George Blanton, Lawson Eaves, Guilford and Spencer Eaves, A. Eaves's hands and William Tanner under James Tanner, overseer. (RCNC Road Docket - 1831 - published in the BGSOTC, November 2007, p 160).
On 26 Sep 1833, Toliver Wallace obtained a bond to marry Nancy Dycus. Larkin Bryan was witness and Wm A. Tanner served as bondsman (North Carolina Archives, RCNC Marriage Bond).
From the Rutherford County, NC Estates, Orphans and Others (BGSOTC, November 2006, pages 162-163), it is found that Toliver Wallace had at least one bound child in his household: Summer 1843 - "Francis M. McClure aged about fifteen years was bound to Toliver Wallis until he attains the age of twenty one years. Wallis agrees to learn said apprentice the art and mystery of a brick mason to give him twelve months schooling and two good suits of clothes extra of his freedom dues said Wallis entered into bond to North Carolina in the sum of two hundred & fifty dollars conditioned not to remove or cause or suffer his said apprentice to be removed or carried beyond the limits of Rutherford County and to deliver him up to the county court of Rutherford whenever he shall arrive at the age of freedom or at any time previous thereto if required. The said F. M. McClure was heretofore bound to James V. Jay who delivered him up to court and was released from his indenture." Apparently, some issue arose that made the court rescind the indenture of the young man, Francis M. McClure: "Ordered by court that a notice issue to Toliver Wallis returnable to next probate court to shew cause if any he can why he shall not surrender to the court Francis M. McClure who was bound to him at this term that the said Francis may otherwise be dealt with as the court may direct." September 1843 - "Ordered by court that the indenture of F. M. McClure to Toliver Wallis be rescinded and that the said McClure be and remain no longer in the possession of the said Wallis or under his control. The court further states that the said McClure be delivered to James V. Jay and that he remain in his possession." By the Fall term of the same court (1843), the indenture had been reinstated: "Francis M. McClure was bound by indenture to Toliver Wallis until he attains the age of twenty one years (being fourteen years old the 19th of October 1843) said Wallis agreeing to give his apprentice at freedom two good suits of clothes extra of his freedom dues a horse extra fifty dollars - to learn him to read and write and to learn him the art and mystery of a mason ...". Around 1866-67, Toliver and Nancy had moved with some, perhaps all, their children to Cobb County, Georgia, and settled in the Marietta area. Toliver Wallace is listed in "Index to Georgia's 1867-1868 Returns of Qualified Voters and Registration Oath Books (white)": Vol. 115, p. 32 and Vol. 205, p. 195, compiled by John David Brandenburg and Rita Binkley Worthy. He took the Oath of Allegiance to the United States on 12 July 1867 in the 898 Election Precinct, Marietta, Cobb County, Georgia.
On 27 Sep 1873, property owned by Toliver Wallis in RCNC was sold at auction by the sheriff to John Allen who assigned the bid to Thomas Miller for $20.00. The description of the property was: "bounded as follows on the waters of Glaghorn Creek [probably the present-day Cleghorn Creek] joining lands with Mrs. Mooney, Mrs. Washburn and the Walton Lands containing ten acres" (Deed Book 51 Page 156). This is the only deed listed in the name of Toliver Wallace in the Grantee and Grantor Indices of RCNC. At this time, it is not known how this land came into his possession. Harry L. Wallace, great-grandson of Wade Hill Wallace (third son of Toliver and Nancy), states in his manuscript titled "The Wallaces - Six Generations, Marietta, Georgia 1844-2003" that Toliver's homestead was located where the present day Austin Avenue runs northeast to meet North Cobb Parkway. The family home was described as built in the basic hall and parlor style. On the site today is the New Life Family Church which faces Austin Avenue, slightly north of a creek. Harry's father, Harold E. Wallace, passed on the family tradition that Toliver was a short man with bushy eyebrows and a wiry build. He wore an old slouch hat and rode a mule wherever he went. [Note: No deed has been found in Cobb County in the name of Toliver Wallace, so the property he lived on and farmed was probably owned by others.] DEATH NOTICE - January 19, 1882 issue of the Marietta Journal:"Died – Mr. Tolliver Wallis, an aged and worthy citizen, died at his home on last Sunday morning. One by one our oldest citizens are passing away." This indicates a death date of 15 Jan 1882. Toliver would have been about 74 years old.
The burial locations of Toliver and Nancy (Dycus) Wallace are not listed in any Cobb County Cemetery transcriptions found to date. A search of the published index for Marietta City Cemetery and other Cobb County cemeteries did not find any marked graves for them.
