"... aangezien de Gedaagde, laatst woonachtig te Edam, in de maand september 1872, als kapitein met het schip Nova naar Petersburg is vertrokken, zonder volmagt tot het waarnemen van zijne zaken gegeven of orde op het beheer van dezelve gesteld te hebben;
aangezien het laatste berigt van hem is ontvangen uit Kronstadt, van den 3den November 1872, en kort daarna het schip Nova op de kusten van Wisby met man en muis is vergaan, zoo als met zekerheid is op te maken uit de aldaar aangespoelde naamborden;
etc. ..."
