3.¬â€ ¬â€ ¬â€ ¬â€ ¬â€ ¬â€ ¬â€ ¬â€ ¬â€ [JANET¬â€ (-1413).¬â€ ¬â€ Her ancestry and second marriage are indicated by the charter dated 18 Mar 1390 (O.S.?) which notes that ·ÄúDominus Thomas de Erskyne miles·Äù recorded a contract between ·ÄúSchir Malcome of Dromonde and Schir Johne of Swyntone apone the landis of the erledome of Marre and the lordshipe of Garvyauch·Äù acknowledging that ·ÄúIssabell the said Schir Malcoms wyf is verray and lauchfull ayre and failliand of the ayrez of hir body the half of the fornemmyt erldome and lordship perteignys to my wyfe of richt of heretage·Äù and requested the king·Äôs confirmation of his wife·Äôs rights[817].¬â€  Balfour Paul points out that "the proof that her name was Keith or that she was the daughter of Sir Edward Keith and Christian Menteith is very meagre, a fact of which no notice was taken in stating evidence for the Mar Restitution Bill of 1885", adds that ·Äúthe pedigree compiled in 1709 by Mr. George Erskine, bailie of Alloa, asserts that such was Janet·Äôs parentage, and it has been taken for granted that he was right·Äù, and reviews the evidence[818].¬â€  The main part of this evidence consists of depositions dated 6 Oct 1447 made by ·ÄúAndreas de Keth de Inverwgy etatis octoginta annorum·Äù who states that ·Äúdomini Roberti de Erskyne comitis de Marr·Äù was descended from ·Äúdomino comiti de Marr dicto Gartnay·Äù, recording that ·Äúdictus comes Gartnay de Marr genuit Donaldum comitem de Marr et duas filias·Äù, that ·Äúidem Donaldus genuit Thomam comitem de Marr et Margaretam·Äù, that Thomas died childless and that Margaret married ·ÄúWillelmo comiti de Dowglass qui genuit ex ea Jacobum et Ysabellam qui sine liberis decesserunt·Äù, that the sisters of Earl Donald married ·Äúuna cum Roberto de Broyss Rege¬â€ [incorrect]¬â€ que sine liberis decessit et alia soror...Domino Johanne de Menteth·Äù by whom she had two daughters, of whom the older married ·ÄúDominus Edwardus de Keth qui genuit ex ea Jonetam·Äù who married ·ÄúDomino Thoma de Erskyn·Äù who fathered ·ÄúDominum Robertum de Erskyn comitem de Marr sepedictum·Äù[819].¬â€  This deposition appears clear, and given the age of the deponent could in part have reflected his own first-hand knowledge of events.¬â€  Whatever her precise parentage, it is clear that Janet was the heiress of the earldom of Mar, presumably descended from a sister of Duncan Earl of Mar.¬â€ ¬â€ m firstly¬â€ DAVID Barclay¬â€ of Brechin, son of ---.¬â€ ¬â€ m secondly¬â€ (before 13 Apr 1370) as his second wife,¬â€ THOMAS Erskine¬â€ of Erskine, son of ROBERT Erskine & his first wife Beatrice Lindsay.]¬â€
