Between Rachel Thom Webb Petitioner and Thomas Webb Respondent

(The following is an account by the Respondent in 1900, 5 years after the Decree Nisi was granted)

On this nineteenth day of February in the year One thousand nine hundred THOMAS WEBB of Lockwood near Canowindra in the Colony of New South Wales Labourer being duly sworn maketh oath and saith as follows:-

1. On the ninth day December last past I was served by William Newton the husband of the Petitioner with a copy of the Decree herein and a copy of the Demand of Rachel Thom Newton.

2. At the time the said Decree was made there were two children of the marriage the subject of this Suit for whom the provision of twelve shillings and six pence per week was intended as well as for the said petitioner and on the twenty fifth day of November One thousand eight hundred and ninety six one of such children name l Robert John Webb died

3. The Petitioner married again about nine months after the Decree absolute herein had been made and at the time such Decree was made I was working on my father's farm which I had previously sold and transferred to him.

4. The said farm is a conditional purchase and a - - - (page break) considerable part of the purchase money therefor still remains unpaid. My father paid me a hundred pounds for the farm and this amount was raised for the purpose of and was expended in paying costs so that I might continue my - - appearance in the Suit. The said hundred pounds was absorbed in paying for the Petitioner and the said children ten - - shillings per week maintenance and (crossed out and initialled) for about four months during the time this suit was pending in paying the - - petitioner's costs which amounted to about Forty pounds and in paying Mr. Crick's costs Forty six pounds incurred by me. (also initialled)

5. After these payments had been made the only property of which I was seised and the only possessions I had were a few farming implements which I sold for thirty pounds or thereabouts. I was now without employment and with little hope of obtaining same as my right hand had been crippled for many years and being strongly advised by my friends to go to South Africa I went there and joined the Bechuanaland Border Police as a trooper.

6. The whole of my pay for services rendered in this - - capacity was little more than sufficient to buy food which was very expensive there and after remaining in South Africa nearly a year during which time and with the utmost care I had succeeded in saving about sixteen pounds I went to New Zealand the amount saved paying my steerage passage and I landed there with my swag and a few shillings.

7. I remained in New Zealand about two years working at various labouring jobs at small wages which were just - - sufficient to keep me and I returned to this Colony about April of last year. On my return to this Colony I was for three months without employment and in despair of ever - - obtaining same returned to my father's farm where I received employment at the small wage of twelve shillings per week.

8. Never at any time since the Decree Absolute was made have I been in the position to comply with the Order and at the present time I have no property either real or personal other than my wearing apparel.

9. No demand for any moneys due under the order has ever been made to me by Ambrose Minslow of Cudal Clerk of Petty Sessions the person authorised to receive such moneys under such Order nor has any such demand been made by any person on his behalf.

10. For the above reasons I am totally unable to pay the amount of alimony due under the order. My relatives have however offered to subscribe an amount of about thirty - - pounds provided the petitioner will accept this in full - - satisfaction of all her claims present and future. They have refused to subscribe more or on any other condition as they say that the petitioner is well provided for by her re-marriage and as to the surviving child they are willing to assist me to keep it if I can obtain its custody either by consent or by means of an application.
