This is the last Will and Testament of me John Trussell of Pirton in the County of Hertford Farmer I give and devise unto my Brother in law Charles Kingsley of Pirton aforesaid Farmer his heirs executors administrators and assignes all my Estate both Real and Personal upon trust to convert into money such part of my personal estate as may not consist thereof and after payment thereout in the first place and in the next place out of my Real Estate if necessary of all my debts Funeral and Testamentary expences upon trust either immediately after my decease or after the decease of my Wife Sarah Trussell if she survives me at his her or their discretion to sell and dispose of all my said Real estate whatsoever and wheresoever for the best price that can be obtained for the same and to invest the money arising from such sale after payment of all expences attending the same together with the Residue of my personal estate after making the payments aforesaid or such residue alone until the sale of my real estate in Government or Real security in the joint names of the said Charles Kingsley or the Party acting in execution of this Trust and my said Wife if living and to pay to or permit my said wife during her life to receive the interest Dividends and Annual profits arising from such Investment and the Rents Issues and Annual profits of my real estate whilst unsold (the same being kept in repair) and after her decease upon trust to divide the Principal money arising from the sale of my Real estate and the Residue of my Personal estate as aforesaid equally between and amongst all my children now or hereafter to be born with benefit of survivorship in case any of them shall happen to die without having attained a vested interest not leaving lawful issue or descendants me surviving it being my meaning and intention that the share of such of them as shall die without attaining a vested interest but shall leave such issue or descendants as aforesaid shall go to and be divided amongst such issue or descendants according to their respective rights and interest therein in like maner as if such child had been living and had attained a vested interest in such share And it is my Will and desire that the share of each of my said children or of such issue or descendants shall be paid to and vested in them as they shall severally attain or have attained the age of twenty one years or marry or be married and in the meantime by placed at interest, the interest of each share to be applied to the maintenance and education of the Party presumptively entitled thereto or suffered to accumulate for his her or their future benefit at the discretion of the said Charles Kingsley his executors administrators or assignes And I hereby declare that the provision hereinbefore made for my said Wife shall be accepted by her in lieu and bar of all Dower or thirds to which she may be entitled out of my said Real estate and that no purchaser or purchasers of my said real estate or any part thereof shall be liable to look to the application or answerable or accountable for the misapplication or non application of the purchase money or any part thereof And I nominate and appoint the said Charles Kingsley and my said Wife Sarah Trussell Executor and Executrix of this my Will hereby revoking all former and other Wills by me at any time heretofore made And I desire that my said Executor and Executrix his or her executors administrators and assigns shall be reimbursed all expenses which he she or they may sustain or be put unto in the execution of this my Will And lastly I declare that neither he she or they shall be answerable or accountable for involuntary losses or for any money but such as he she or they shall respectively actually receive In witness whereof I the said Testator John Trussell have to this my last Will and Testament set my hand and seal this twenty fourth day of July in the year of our Lord one thousand eight hundred and thirty eight.
