Notes about John COGGER

Joint overseer of Will of brother in law, James Herwood 1705 Joint executor of Will of his father in 1707. Received half of his personal estate. Executor of will of sister, Mary Harrod, 1718; received residue of household goods etc, and quarter share of the remainder of his real estate (with his brothers) plus a quarter of any residue of the sale of Little Kippington etc. John, and his mother Elizabeth, were left the main estate of his father in equal shares. Elizabeth probably died in 1726 (no sign of a will yet) and her share may have reverted to John. Thus in 1744 John left the following will leaving the bulk of his estate to his nephew William, son of Thomas Cogger of Ightham. IN THE NAME OF GOD AMEN I, JOHN COGGER of the parish of Sevenoaks in the County of Kent Yeoman calling to mind the uncertainty of this life and that is appointed for all nor once(?) to dye and the uncertainty when the same shall happen do therefore make and ordain this my Last Will and Testament in manner and form following first I resign my soul to God that gave it and my body I commit to the earth to be dutifully buried at the discretion of my Executors hereinafter named and as to the Temporal Estate which it hath pleased God to bless me with I give and dispose thereof as followeth, first I order that all my just debts and funeral expenses be first paid and discharged Item I give and bequeath unto my nephew JOHN COGGER son of my brother FRANCIS COGGER the sum of fifty pounds to be paid him within twelve months next after my decease Item I give and bequeath unto my nephew ISAAC BURGIS son of my sister JANE BURGIS the sum of fifty pounds to be paid him within one year next after my decease Item I give unto my nephew WILLIAM COGGER son of my brother THOMAS COGGER all my Messuages Tenements Farms Land and premises with their appurtenances lying and being in the County of Kent or elsewhere that I shall dye possessed of or interested in I hold unto my said nephew WILLIAM COGGER his heirs and assigns forever subject nevertheless and chargeable with the payment of all my just debts and legacys in case my personal estate shall not be sufficient to pay and discharge the same Item all my Goods Chattels and personal estate that I shall dye possessed of I give and bequeath to my brother THOMAS COGGER and my nephew RICHARD HILLS whom I hereby nominate constitute and appoint Executors of this my Last Will and Testament in trust for the payment of my debts and legacys hereby given and the remainder over to and for the benefit use and behoof of my said nephew WILLIAM COGGER his executors and advisors. Item I will and direct that my said executors shall receive the rents issues and profitts of all my lands and tenements untill my said nephew WILLIAM COGGER shall attain to his full age of one and twenty years to be applied to and for the use and benefit of my said nephew WILLIAM COGGER (my just debts and legacies being first paid and discharged as aforesaid). Item I order and direct that my executors and each of them shall from time to time and at all times during the time that they shall act in and about the execution of this my Will deduct out of my real personal estate money sufficient to pay and defray all the cost suit troubles charges damages and expenses that they or either of them shall any wise sustain or be put into touching(?) or concerning the same and all other charges and expenses incidental thereunto Item I revoke and make void all former wills and bequests by me at any time heretofore made in witness whereof I the said Testator have to this my Last Will and Testament written on two sheets of paper to each sheet thereof set my hand and seal this thirty first day of December in the twelfth year of the Reign of our Sovereign Lord King George the Second by the Grace of God of Great Britain, France and Ireland, Defender of the Faith and so forth and in the year of Our Lord One thousand seven hundred and thirty eight JOHN COGGER - signed sealed published and declared by the Testator as his Last Will and Testament in the presence of us who in his presence and at his request subscribed our names as witnesses: THOMAS GYLES, THOMAS HORTON, MATH. PEARSTON. THIS WILL was proved at London before the Worshipful ROBERT CHAPMAN Doctor of Laws Surrogate of the Right Worshipful JOHN BETTESWORTH Doctor of Laws Master Keeper Commissary of the Prorogative Court of Canterbury lawfully constituted the twenty third day of October in the year of our Lord One thousand seven hundred and forty four by the oath of THOMAS COGGER the brother of the said deceased and one of the executors in the said Will named to whom administration was granted of all and singular the Goods Chattells and Creditts of the said deceased being first sworn duly to administer power reserved of making the life Grant to RICHARD HILLS the other executor when he shall apply for the same. Precis of Will dated 31st December 1738 and proved 23rd October 1744: £50 to John Cogger, son of brother Francis; £50 to Isaac Burgis, son of sister Jane Burgis; William Cogger, son of brother Thomas is the main beneficiary, receiving "all my Messuages Tenements Farms Land and premises with their appurtenances lying and being in the County of Kent or elsewhere" (subject to payment of debts & legacies); personal estate to brother Thomas and nephew Richard Hills, executors, to receive rents etc for benefit of William until 21.
