WILL of JOHN GRIFFIN
This is the last Will and Testament of me JOHN GRIFFIN of the Ffolly ffarm in the parish of Tring and County of Hertford Ffirst I desire all my just debts funeral and testamentary expenses to be fully paid and satisfied as soon as conveniently can be after my decease I give and bequeath unto each of them my Brother WILLIAM GRIFFIN of Wingrave in the County of Buckingham and THOMAS WOODMAN of Grove ffarm in the said parish of Tring the sum of ten pounds for his trouble and I hereby constitute and appoint them Executors of this my Will I give and bequeath unto the said WILLIAM GRIFFIN and THOMAS WOODMAN their executors and administrator All my Personal Estate whatsoever and wheresoever that I shall die possessed of or entitled to Upon trust for my wife CHARLOTTE GRIFFIN in case she shall survive me and my children JOHN, JANE, EMMA, CHARLOTTE KINGSLEY, THOMAS, SARAH, JAMES, CHARLES and HESTER in the following proportions one third part thereof to my said wife to be paid assigned and transferred to her as soon as conveniently can be after my decease and the remainder between my said children who shall attain the age of twenty one years or died under that age leaving lawful issue in equal shares and proportions and to pay assign and transfer the same to them respectively when and as they shall respectively attain that age and in case my said wife shall not be living at the time of my decease then the whole of my said Estate to be divided between my children in manner aforesaid And also upon trust in the mean time to apply the whole or a competent part of the annual produce of such estate for and towards the maintenance education and support of such children during their respective minorities and to accumulate the residue (if any) in the discretion of my said Trustees which accumulations I declare shall be considered as part thereof Provided always and my mind and will is that if my said Trustees shall think fit so to do it shall be lawful for them to carry on the ffarm which I now hold and to retain unsold and unconverted so much of my live and dead stock furniture and other personal estate as may be requisite for carrying on the said farm and paying the rent and other expenses thereof And that my said trustees may permit and suffer my wife (in case she joins and assists in carrying on the said farm which I hope she will do) and children to reside in the dwelling house of the said farm during so long as the said trustees shall carry on the same And that it shall be lawful for them at their discretion to discontinue the said ffarm at any time they shall deem it expedient so to do and that they shall sell and dispose of the live and dead crops furniture and other estate and effects so employed as aforesaid and invest and apply the proceeds in manner hereinbefore directed with respect to my personal estate generally and I hereby declare that the power herein contained shall not prejudice the right of my said children on attaining their respective ages of twenty one years to receive his or her share of my said Estate but that such of them as shall so receive his or her share shall not be entitld to reside longer on the said ffarm And I do hereby declare that the receipts of my Trustees and Executors for the time being of this my Will shall effectually discharge any purchaser or other person paying money under this my Will or the trusts thereof And that such trustees and executors may submit matters to arbitration vary securities for others of a like nature take securities or give time for the payment of the debts or otherwise act as they may deem beneficial for my estate And I do further declare that on the death refusal or incapacity of all or any Trustee or Trustees the surviving or continuing trustee his executors or administrators may appoint a new trustee or trustees as occasion may require by writing under his hand who may act in the same manner as if named in this my Will and I further declare that my trusttes and executors for the time being shall only be answerable for their respective wilful defaults and that they may reimburse themselves and their Cotrustees and Coexecutors all costs and expenses incurred in or in relation to the trusts of this my Will and lastly revoking all former Wills I declare this to be my last Will and Testament In witness whereof I have hereunto set my hand this fifteenth day of ffebruary one thousand eight hundred and thirty nine JOHN GRIFFIN Signed and acknowledged by the said JOHN GRIFFIN in the presence of us both present at the same time who in his presence at his request and in the presence of each other have signed our names as Witnesses GEORGE LOCKTON FAITHFULL Sol'r Tring MARY ANN FAITHFULL Tring PROVED at London the 24th June 1843 before the Worshipful John ........ of Laws and Surrogate by the Oaths of WILLIAM GRIFFIN the Brother and THOMAS WOODMAN the Executors to whom administration was granted having been first sworn duly to administer
