DIVORCE CASES.
DENNIS V. DENNIS AND GIBSON.
Before the Full Court yesterday, the
divorce case of Dennis v. Dennis, and
Charles Gibson co-respondent, was heard,
being a petition by the husband for
dissolution of marriage.''
Mr. Percy Crisp (Simmons, Crisp, and
Simmons) appeared for the petitioner.
There was no appearance of either the
respondent or co-respondent.
Mr. Crisp stated that the marriage took
place at Sandown, North-West Coast, on
October 10, 1899, and the husband and
wife lived together at Forest until June,
1903, when the petitioner met with an
accident, which necessitated his removal
to Launceston Hospital. His wife went
with him to Launceston, arranging to
lodge with her sister. When he got out
of the hospital he found his wife had gone
to Burnie, and he joined her there. After
two days he left for his home at Forest,
when she refused to go with him. Some
months subsequently a child was born,
of whom the co-respondent was the alleged
father. There was only one child of the
marriage, a girl.
The petitioner gave evidence to the
above effect. He added that when his
wife would not return with him to his
home at Forest, she refused to give up
the custody of his little girl.
An affidavit by Mr. F. C. Wills, Registrar
of Births, Burnie, was put in, showing
that the respondent had stated to
him that the co-respondent was the father
of her second child, but she registered it
in the name of Dennis. Another affidavit,
which was by Eliza Blizzard, Circular
Head, showed the relations between
respondent and co-respondent.
The Court required the evidence of the
respondent's sister at Burnie, in whose
house the second child was born, and the
further hearing was adjourned for this
to be produced, orally or by affidavit.
