Notities over William Dood Howard

William Howard married Mary Salyer

William was the youngest brother of James, he was born in Russell County, Virginia (1860 Breathitt County U.S. census) in 1783, died 6 March 1868. He is buried in the William Howard Cemetery which is in Breathitt County on Rt 542. This location is the Quicksand area at the mouth of Spring Fork. Connie A. Wireman located this cemetary in 1978 and copied the information from the 9 graves which had markers. There also 20 graves in the cemetery which are unidentified.

William was married to Polly Salyer who was also born in Russell County, Va. in 1787, died 3 November 1867 and is buried beside her husband. Polly was a sister to William M. Salyer and deeds seem to prove that they were 2 of the 11 children of Isaiah Salyer.

William and Polly were probably married in Russell County, Va., 1808. Russell County, Va. records were lost to a fire 1853. Isaiah Salyer sold most of his land in Russell County, Va. in 1800 and moved his family to the Cumberland River section of Knox County, Kentucky where he was given a grant for 150 acres. His land was located on the north side of the river below Ashers Ford. For some unknown reason Isaiah returned to Russell County with all of his children in 1807, he purchased land and remained in Russell County until he died in December 1818.

William and Polly Howard lived on Cumberland River in Knox County, Ky., in the same area as the Howard brothers and old James Howard, Senr. and also close to old David Arnett and Garnett Jackson whose wife was Nancy another daughter of Isaiah Salyer. William can not be located on tax list in Knox County after 1811. Because of the missing Floyd County lists there is no way to know exactly when our Howards actually moved to Floyd County. Some were there as early as 1813. This William Howard is not to be mistaken with the William Herd (Hurd,Hord) who was also on the Knox County tax lists and can be followed later on the lists of Clay Co., Ky.

The first deed found concerning this William Howard is in Floyd County Kentucky Deed Book C, p. 64.
29 September 1826 Adam Gearheart of Floyd County sold a tract of land on Trace Fork of Licking River, beginning 18 poles above the mouth of Trace Fork, to William Howard of Floyd County. In 1849 William and Mary Howard sold land to John Allen. The deed was made 27 January 1849 but not recorded until 25 July 1853. Floyd County Deed Book F., p. 392. It was proved by Green, one of the witnesses to the deed.

Floyd County Deed Book F, p. 378: Another deed made also on 27 January 1849 from William Howard to Thomas L. Howard. Thomas was a son of the Howard who changed his name to Lovely.

In 1838, William and Polly Howard were living on Quicksand in a section which was set off to Breathitt County in 1840. William Howard's Will made in April 1866 and entered for probate at the March Term of Court has been re-recorded and can be found in Breathitt County, 13 August 1888. In the Will he named all of his sons except Benjamin who died in 1856. His son John was also deceased but he is mentioned in connection with the bequest which was made to his only child Idres, daughter of John and Nancy Allen Howard.

Will of William Howard written 2 April 1866:

I William Howard of the county of Breathitt and the state of Kentucky being of sound mind and disposing memory but greatly on the decline of life and calling to mind the uncertainity of human life and being desirous to dispose of a portion of small worldly estate as it hs pleased God to bless me with. I give and bequeath the same in the manner following to wit:
1st I give my soul to God who gave it.
2nd I wish all my just debts be paid at my death if any I owe.
3rd I will and bequeath to my son George Howard the lower end of a farm lying on Quicksand Creek in Breathitt County Kentucky, up to a conditional line between said Howard adn the heir of John Howard deceased which boundary is described in a deed to said George Howard.
4th I will and bequeath to Ides Howard daughter of John Howard, deceased from an conditional line between George Howard and said Heir up to the conditional line between said Heir and Andrew Howard, which line is described in a deed to said Heir.
5th I will and bequeath unto my son Andrew Howard a portion of land lying on Qui;cksand above and adjoining the land of Ides Howard, Heir of John Howard deceased from the conditional lline between said Heir and Andrew Howard up Quicksand to near the Ford of Quicksand and the conditional line between said Andrew Howard and Samuel Howard which conditional line and boundary is described by a Deed said Andrew Howard holds for the same.
6th I will and bequeath unto my son Samuel Howard a portion of land lying on the Spring Fork of Quicksand from the conditional line between Andrew Howard and the said Samuel Howard thence up said Spring Fork to the upper end of said farm which bondary is described by a deed said Howard holds for the same.
7th I will and bequeath unto my son Riley Howard a portion or parcel of land lying mostly on the Main Fork of Quicksand from the conditional line between the said Riley Howard, Samuel Howard, Andrew Howard and the Heir of John Howard deceased thence up the Main Fork of said Quicksand to the conditiional line between the said Howard and George Howard which conditional line and boundary of said land is described by a deed which the said Riley Howard holds for the same.
8th I do by these presents constitute and appoint my son George Howard as my Executor to see that my will is executed. Given under my hand this 2nd day of April 1866.

The forgoing will of Willam Howard deceased was produced in Breathitt County Court at the March Term 1868 and proven to be the last Will and Testament of William Howard deceased by the oath of Stephen Carpenter and William Barnett two of the attesting witnesses thereto to be the act and deed of said Willliam Howard deceased and signature of Alexander Carpenter one of the attesting witnesses thereto also proven by the same. Which will was ordered by said court to be recorded in the clerks office of th Breathitt County Court as the last will and testament of William Howard deceased. Whereupon said will together with this certificate is duly recorded in my office. Given under my hand this 23rd , day of March 1868. Edward Marcum, Clerk

I J. Wise Hagins Clerk of Breathitt County Court certify that the foregoing will from William Howard was produced to me to be re-recorded, the same having been recorded, the same having been recorded March 23rd 1868 as appears from the preceeding certificate of Edward Marcum as Clerk of the Breathitt County Court but the record of same having been destroyed I have rerecorded said will and said certificate and recorded this my certificate in my office. The following endorsement appears on said will, Recorded in Will Book N, page 23.
