Audit of Jacob's Estate 7/20/1853
To the Honorable, the Judges of the Orphans court of Chester County.
The undersigned, appointed by the annexed order to audit and examine the account of George Ludwick Executor of Jacob Ludwick late of the township of West Vincent in said county dec respectfully submits the following report
The auditor sat in accordance with prior arrangement to here the parties of his office in the borough of West Chester on the twentieth day of July 1853.
There were present at the hearing the accountant, with his counsel,
Andrew Miller, Esq. The three Expectants viz: George Miller, executor dec. of
Henry Miller dec and George Ralsfon, guardian of the minor children of John
Miller , dec with there counsel , John Hickman Esquire; - and Sarah Faulkner, with her counsel, Joseph J Sem's Esq.:- Jacob Ludwick and Hannah Ludwick ,children of the decedent were likewise present, - Mr. Sem's being there counsel also.
The testifier died in the year 1833 , in or before the month of June, seised of the following described real estate, viz: A messuage in the two lots in West Vincent township, Chester county, containing together about sixteen acres of land: a tavern house and a lot of land in Marrietta, Lancaster county and a hatter shop and lot of land in the same place .
The inventory of his personal estate filed June 28, 1833 amounted to $2,200.40 His will _________September 19, 1828 and was proved June 6, 1833.
After the payment of his funeral expenses and debts, he gave to his wife Mary, the free and entire use and profits of all his real estate during her life and gave her his personal estate during the same time. He directed his executor after her death to sell his personal estate that might "then be left and remaining "- and all his real estate at "such times, ways and terms as he may conceive most advantageous to his estate. He directed the money arising therefrom, with all other money belonging to his estate, to be equally divided amongst his nine children, viz: Elisabeth, George, Phebe, Catharine, Sarah, Hannah, Jacob, John, and Nancy and his Granddaughter, Sarah Williams directing further as follows, viz: Any sum of sums of money that I have had for any of my children or given to them or other for open by which I have given to them and which I have charged them with in my family book (so called) is to be taken out of their respective dividends , by my executor . It is desired to be understood, that my will and desire is that all my children or there legal represent alive should have an equal share of my estate. He directed that the shares of his daughters, Catharine and Sarah be put to interest by his execrator and the interest be paid to them annually, but in case either should survive her husband the principal was to be paid to her. He directed the share of his son Jacob to be put to interest and the interest paid him annually. ______________________________

Should the interest prove insufficient for his comfortable living. Should Jacob become a sober and well doing man he directed the principal to be paid to him. He appointed his son George executor . His widow died April 10 1835 His daughter Elisabeth was married to Henry Miller, -She and her husband are dead: The minor children of whom George Ratston an expectant , is guardian of one grandchildren of Elisabeth.- Phebe was married to John Moses and survives him. Catharine was married to John Trump and survives him: -Sarah was married to Thomas Fautkner and survived him:-Ann- called Nancy in the will, married John Robb and survives him: -Sarah Williams married Adam Reitenbaugh, both are living:-George Hammah, Jacob and John are still living .Jacob has become a sober and well doing man. At the testators death the tavern property in Marietta was rented to James Stackhoride for three years from April 1, 1831 at a rent of ninety dollars per annum . He continued in possession under the executor till April 1, 1851 being sixteen years from the death of the widow. The rent for the last twelve years of that time, the executor admits to have been one hundred and fifty dollars per annum:-and not showing that any offer sum had been paid for the remainder-of the time, he is to be charged at that rate for the whole period.-An allowance in his charge is to be made to him for $291.35 lost by the insolvent___of the tenant who died about 1851;

Have been paid according to the conditions of the sale. Brenbrs app. 7barr 333. Samberhown Smitts, 13 S&R 310 . Interest is to be charged also on the purchase money of the other real estate from one year after the sales. Hannah and Ann Ludwick not having complied with there part of the contract for the purchase of the West Vincent property and that sale not having been perfected,-are est offered claiming anything beyond the proceeds of the sale of 1851:-the auditor will so report that justice will be done between them and the executor.
The account stated by the auditor show that the balance against the executor April 10, 1836 on account of the personal estate, was 1768.39 adding interest on this sum for seventeen years $1803.75 and the several changes in the testators book against his children and allowing a credit of $90. Commission on the interest changed the balance of the personal estate for distribution is found to be $4,133.26
Against Sarah Williams the granddaughter and a legatee there is no charge in the testators book. There is however a charge of $120.63 against her mother, Margaret Williams, who was dead at the date of the will. The auditor thinks there can be little doubt on a fair construction of the will that the testator,-declaring that all (his) children at their legal representative should have an equal share of (his) estate ,-designed this change to be put to his grand daughters account looking upon her as the representative of her mother. In the account of the real estate the executor is charge with $5,177. As the proceeds of sale; $3124.92 interest and $2,244.65 __________________________

All the parties present and their counsel agreed that the auditor should report a distribution of the balance, charging the legatees against their share with such sums as it should appear the executor ought to be credited with: the report to have the same effect as if the auditor had been appointed by the Orphans Court for that purpose.-Ann not being present or represented before the auditor can not be bound by the report even if she neglects to except to it. If she were to receive an equal share of the general balance, she would according to the principles stated in the report be receiving more than she is entitled to, by her share of the amount of the difference between the mo. Sales $1,152.00 interest for sixteen years on that sun $1,105.92 and one half of one years rent of West Vincent farm, in all $2,292.92. This sum being deducted from the general balance will leave $11,810.91 which the auditor reports to be the balance one tenth of which is Ann's distributive share.
On the fourth day of May 1839, Robert Ralston, agent of Henry Miller and Elisabeth his wife, made a settlement with
The executor for her share. As far as he has settled the estate a balance of $262.62 was found to be due the executor and more given for that sum, to be deducted out of her share after that sale of the Marietta property.-A copy of the note is annexed.
