Notes par Henry DAVIS

1st deed in Bedford dated 1812

Henry DAVIS of Bedford Co., TN was born in Brunswick Co., VA to Benjamin DAVIS and his wife Tabitha ROSE. This is confirmed by the Will and estate settlement of Benjamin DAVIS of Brunswick Co., VA in 1817. In his will, he names his children - including Henry and Thomas. But the link to the particular Henry and Thomas DAVIS in Bedford Co., TN is made in the estate settlement where they both name, along with another brother, John, who was residing in Robertson Co., TN at that time, as their Attorney, Peter RAGSDALE.

According to tax, census and deed records, in 1817 there were not another pair of “Henry and Thomas DAVIS”, brothers. Both Henry and Thomas played prominent roles in the early formation of the towns of Fairfield and Shelbyville in Bedford Co. from about 1810. Henry opened one of the first mills, and Thomas was Postmaster.

According to local histories, a Henry DAVIS was one of the earliest settlers of Bedford Co., TN, and in particular - the now extinct town of Fairfield. The following description is from Goodspeed’s Biography of Bedford Co. in 1887.

“Fairfield, fourteen miles northeast from Shelbyville, in the First and Second Districts, is one of the oldest towns in Bedford County. The town lies on both sides of Garrison Fork of Duck River, which stream is spanned by a large bridge at the town, and is distant from Wartrace four and a half miles and from Bell Buckle five miles. The land upon which the town was founded was owned by Dr. J. L. Armstrong and Henry Davis; that on the west side of the creek belonged to Dr. Armstrong and was called Petersburg; that on the east side by Mr. Davis and was called Fairfield. The two towns were laid off into lots, and the lots were sold some time in 1830. From 1835 to about 1850 Fairfield (the name of Petersburg was soon dropped) was one of the most flourishing towns in the county, and a large amount of business was annually transacted. The building of the Nashville & Chattanooga Railway destroyed the business to a great extent, and since that time the town has gradually but steadily declined, and at present there are not over fifty inhabitants. The early business men of Fairfield were Josephus Erwin, William Crutcher, William Hickman, Henry Davis, Isaac Miller, William Clark, Henry Davis, Jr., James Word, John West, _____ Marshall, David Brown, James Martin, _____ Miller and James Simms.  Osbom & Bro. are the business men of the present. The blacksmiths are Osbom Bros. & Justice, James Martin and Buck Butner.  H. A. Justice & Son have the one corn mill, which is on Garrison's Fork and is of water-power. The physicians of Fairfield and vicinity have been as follows: Drs. James L. Armstrong, Thomas B. Mosley, Needham King, Robert Singleton, George B. Sumner, David King, Allen Hall, J. B. Muse, Jack Morgan and Robert Morgan. Those of the present are Drs. Joshua Ganaway, Smith Bowlin, R. W. Kirch and S. K. Whitson, Fairfield has four churches-two white and two colored. The former are Missionary and "Hard Shell " Baptists, and the latter are Missionary Baptists and African Methodist Episcopal.  The schools of the town are the Fairfield Academy (chartered), which enjoys an excellent reputation, and the colored free school. “

There are confusing notations in local histories. More documentation needed. (A will has not been found.) He seems to have died sometime in 1838. Last deed was sealed by him in Dec 1837 and Jno. & Thos. DAVIS are listed as Extrs. of his estate in Jan 1839.

By 1821, Henry DAVIS sold a couple pieces of property and then secured a note with personal property, mortgaged to Thos. DAVIS (his brother) and Leonard P. SIMS (brother-in-law). Henry appears to have had a cashflow problem at this time. There is, however, an interesting list of personal affects.

After his death ca 1838, several Lots in the Town of Fairfield were sold by his executors. Speculate that this was to pay off any debts. , , ,
Henry and brother Thomas appear to have been in business together.

This Indenture made this first day of October in the Year eighteen hundred & twelve between Benjamin BRADFORD Sherriff of Bedford County and State of Tennessee of the one part and Thomas and Henry DAVIS of the other part. Witnesseth that the Said Benjamin BRADFORD Sherriff of Bedford by Virtue of a Writ of Vendetions expense to him directed by the County Court of Bedford to him directed at the instance of Joseph PHILLIPS Proceeded to Sell a Certain Tract Piece of Parcel of Land lying in the County of Bedford Known and distinguished in the Plan of the Town of Shelbyville by Lot No. 108 as the property of James HOLLAND and having given the Requested Notice Required by Law proceeded to Sell all the right and interest which the said James HOLLAND had in and to the said Lot No. 108 Known & distinguished as aforesaid on the 12th day of September 1812 at the Court house in Shelbyville In the County of Bedford in a publick manner the Interest Further Witnesseth that the said Lot No. 108 being publickly exposed to Sale and there being many bidders for said Lot No. 108 the said Thomas & Henry DAVIS among others publickly offered for Sale Lot No. 108 the sum of eleven dollars it being the highest bidder to the Cries of Said Lot and the said Crier Sold off said Lot to said Thomas & Henry DAVIS by Virtue of said Writ of Vendetions expences to him directed This Indenture further Witnesseth that the sd. Benj. BRADFORD Sherriff as aforesaid for and in consideration of the sum of twelve dollars to him in hand paid by the said Thomas & Henry DAVIS the receipt whareof is hereby acknowledged, hath Sold aliened & Confirmed unto the said Thomas & Henry DAVIS the sd. Town of Coffeeville as Lot No. Sixty three fronting East side of the public square, fifty nine feet 9 inches running back one hundred & thirty two feet, Beginning on the public square at the North corner of the above Lot , And run South with said Square so as to include one half of said Lot, and thence East to the back line so as for said DAVIS to have his half on the north side of said Lot. With all and Singular the appurtenances and hereditaments thereto or in any wise appertaining unto him the said Henry DAVIS his heirs and assigns forever, with all the Estate right, title, interest & claims, Henry DAVIS his heirs & assigns, And the said John W. RAGSDALE doth covenant to and agree with said Henry DAVIS to Warrant and defend the right to the one half of the before mentioned Lot or parcel of Ground, unto him the said DAVIS his heirs and assigns from the claim or claims of all persons whatsoever to claim the same, or any part thereof, In Witness whereof the Sd.     This indenture made this Twenty ninth day of December in the Year of our Lord one Thousand eight Hundred & Twelve between Frances MURRAY of the County of Bedford and State of Tennessee of the one part and Thos. & H. DAVIS of the County & State aforesaid Merchants & Copartners in Trade under the firm & Stile of T & H DAVIS of the other part (Witness) that the said Frances MURRAY of and in consideration of Two Hundred Dollars to him paid the receipt whareof he doth hereby fully acknowledge hath granted bargained & sold & do by these presents bargain grant Sell Convey & Confirm unto the said T & Henry DAVIS their Heirs Executors & Administrators forever one part of a Certain Lot in the Town of Shelbyville known & Distinguished in the place of said Town by No 37. and conveyed by the Commissioners of said Town to Clement CANNON and bounded and Butted, viz: Beginning at the South West Corner of said Lot to a Stake runing thence East to the Seven feet thence West to the North Thereby Seven feet thence West to the Northeast Corner of James EDDE Sadler's Shop thence South Sixteen feet thence West twenty one feet thence South Twenty one feet to the Beginning To Have and to Hold the said Lot or parcel of Ground and every part thereof with woods waters minerals priveleges & advantages Whatsoever to the only use benefit & behoof to them the said T & H DAVIS their Heirs Executors and administrators forever as also the right Claim & interest property & demands Whatsoever he the said Frances MURRAY his Heirs Executors administrators had of in and to the said Lot or part thereof & the said Frances MURRAY do bind himself his Heirs Executors & administrators to Warrant and defend the said Lot or part thereof To the sd.     This indenture made this Nineteenth day of March in the year of our Lord one Thousand Eight hundred & thirteen Between James EDDE of the County of Bedford and State of Tennessee of the one part and Thomas & Henry DAVIS of the County and State aforesaid of the other part. Witnesseth the said James EDDE for and in consideration of one Hundred Ten Dollars to him in hand paid the receipt whareof he doth hereby fully acknowledge hath granted Bargained and Sold and do by these presents bargain grant Sell Convey and Confirm unto the said Thomas & Henry DAVIS their Heirs Executors & administrators for even one part of a Certain Lot in the Town of Shelbyville known and distinguished in the plan of said Town by No. 37.
