Benjamin Montanye Fetter and his wife migrated from Pennsylvania to California before May of 1853. He was mentioned in an article in the Sacramento Union, dated 24 May 1853 as a delegate to the State Convention from Sierra County, California. He was Sierra County Treasurer in 1854 and 1855. In 1856, he was the Wells Fargo Agent for Downieville, California. I have a copy of a letter written on his behalf in 1856 from the Bridesburg, PA IOOF (Independent Order of Odd Fellows), declaring him a member in good standing and wishing him good luck.
A Sierra County audit revealed a discrepancy involving a deposit into the State Treasury during his tenure as Treasurer . On 15 January, 1857, the Sacramento Union printed Mr. Fetter’s defense, written by him, explaining the circumstances for the tardy deposit, involving an incorrect audit certificate that had to be corrected, a medical illness involving his wife forcing his immediate return to Downieville before the business was concluded, and a Wells Fargo cashier in Sacramento who did not deposit the gold and silver entrusted to him in a timely manner. On 27 October, 1858, both he and Benjamin Green, his successor as Treasurer, were on trial for embezzlement. On 28 December, 1858, the Sacramento Union printed that both Fetter and Green had been washed of the charges preferred against them. By September of 1861, he had moved to Santa Rosa, north of San Francisco. He is listed as a Santa Rosa farmer in the 1870 U.S. Census. He is cited in the 25 May 1872 edition of the Sonoma Democrat as one of the largest vinegrowers in the vicinity.
Starting in 1875, he is listed in the San Francisco City directories, as a mining and real estate agent. In 1877, his office was at 605 Montgomery Street, the block now occupied by the Transamerica Pyramid building. He was in Globe, Arizona Territory, probably on a mining business trip, when he died, and was buried there.
In the San Francisco Call newspaper, dated 20 March, 1895, B.M. Fetter’s widow, Mrs. A.W. Fetter, as well as James de La Montanya, another descendant of Johannes de La Montagne, is featured in an article titled THE MONTANYAS AFTER MILLIONS. This involved an attempt to recover funds supposedly owed to the heirs of numerous New Netherland families by Trinity Church. Further research has shown that this claim was a recurring fraud dating back to pre-Revolutionary War days, and one can only hope they were not taken in by the perpetrators.
His widow and five children, Alvah C., Benjamin M., Emma, Frank C. (my great-grandfather) and Addrianna W. are interred together at Cypress Lawn Cemetery in Brisbane, California.
