Peter Apperson, second child of William and Elizabeth Kerr Apperson, was born March 23, l784, on their plantation in Surry County, N.C., near the present town of East Bend. The date of birth is confirmed by the family page of his parents Bible, as well as by his gravestone on his homestead near Waxanachie, Texas.
Following is a copy of the will of Peter Apperson:
The State of Texas, County of Ellis, Know all men that I, Peter Apperson, of the State and County afore-said, being now sick and in a low state of health, but of sound mind and disposing memory and, knowing that it is appointed for all men to die, and, being desirous to make such disposition of my property among my children as shall be equitable and just, do by these presents make this, my last will and testament, hereby annulling and voiding all other documents purposing to be my will and testament.
First, it is my will that my wife, Elizabeth, for the love and affection that I entertain for her, have and enjoy all of my property of every description, real, personal and mixed, receiving all the benefits and profits arising there from during her natural life, she observing and performing all the bequests and directions hereinafter made.
1st. I hereby give and bequeath to my son, James Petty; when he arrives at the age of twenty-one, or marries, the Negro coy, Charles, or Charley, valued by me at $600.00; also one horse, saddle and bridle, valued at $100.00. It is further my wish that he remain with and manage for his Mother and that she pay him reasonable compensation for his and the boy Charley's services.
2d. I will and bequeath that my son, John Thomas, be raised and educated by his mother, whom I hereby appoint his guardian; he to be raised and educated out of my effects and free of charge, and, when he arrives at the age of twenty-one, or marries, he is to receive $1,600.00 in property or money, as may best suit the convenience of his guardian, and, should my wife die before he is of the age of twenty-one, and make it necessary for a division of my estate, that the said sum of $1,600 be set apart and given to my son, John Thomas, over and above an equal distribution of the amounts of my estate then on hand, and that the Probate, or Appraiser's Court, appoint a Guardian for him, the said John Thomas, my son. It is my wish and desire that at the final distribution of my estate that my children should receive an equal share of the same, to be governed by the principle of equity. It is also further my will and desire that should my wife, Elizabeth, at any time marry, that the property belonging to the estate be forthwith divided equally between my children and my wife, but, as long as she remains in her widowhood, she is to retain the possession and use of all of the estate not otherwise bequeathed and, should she wish to change or sell any of the property of the estate, I hereby authorize and empower her so to do, giving her full power and authority to convey all right and title heretofore vested in me, independent of legatees. I hereby appoint my wife, Elizabeth, and my son, James Petty, conjointly Executrix and Executor, to carry out my intentions and wishes hereinbefore expressed, directing that no action of the Probate Court be upon this my last will and testament except the proving, recording and granting Letters Testamentary, dispensing with bond security entirely.
