ANCESTRY OF ELIZABETH (JONES) GARNETT by George B. Loeffler, Sr.
William [1] Jones, grandfather of Elizabeth [3] [Jones] Garnett, (will dated October 19, 1743, probated March 20, 1743/4, Essex Courty Will Book #7, page 95) names wife Elizabeth in hi will.  Whether or not she was the mother of some or all of his children, we do not know.  His children were: 1] Martha m. Cornelius Sale; Hannah m. _____ Sale; Ann m. _____ Goode; James Jones; John Jones; Thomas Jones; and Robert Jones.  These last three sons (who predeceased him) are not mentioned in his will, but proof that they are his sons will be given later in this article.
The will of the above William Jones of the parish of St. Anne and County if Essex, Virginia, is as follows: Wife Elizabeth all estate real and personal for her lifetime, except three negroes and my riding horse, negroes Isaack, Nan, and Rose, now in the possession of Cornelius and Martha Saile My son-in-law and daughter, also the plantation I now live on after my wife's decease, to my son-in-law and daughter Cornelius and Martha Saile.  To my son James Jones ten pounds. Remainder of estate to be divided among my three daughters Martha Saile, Hannah Saile, and Anne Goode.  Witnesses Nathaniel Fogg and Sarah Bastin (?sp).
Thomas [2] Jones (son of the above William and brother of Johns) left a will dated 26 December 1738 and probated 20 March 1738/9 (Essex County, Virginia, Will Book #6, page 159) Naming wife Mary and six children as follows: to my son Thomas [3] plantation on which I now live; to my son William [3] land I bought of Honorius Powel; to my son John [3] land near Capt. Garnett's Mill which I bought of John Rouzie; to my daughter Suca [3] one negro girl named Sarah aud to my daughter Mary [3] one negro girl named Susana. Remainder to be divided among children and their parts to be delivered to each at age 21 or equally divided among survivors.  Sons Thomas [3], William [3], and John [3] after 21 each to pay an annuity of four pounds toward maintaining of my son Robert [3]. To my wife Mary, plantation where I live during her life.  Wife to be Executrix and friends John Rowzie, Charles Mallor and John Carrios.  Will Book #6 , page 261 shows the estate divided into six parts, the widow and five children.The parts of Thomas [3] and Mary [3] when they died were redivided among the survivors.  Will Book  #7, page l shows division of Estate of Thomas Jones, Infant, one of the sons of Thomas Jones late of Essex County among surviving children of said Thomas Jones; William Jones, John Jones and Sucre Jones by Aug. Boughan, Anthony Garrett and Henry Motley on 15 March 1742/3. Mary had apparently predeceased her brother Thomas.)
Mary, widow of Thomas Jones (and daughter of Edward Rowzie) married second James Garnett as his third wife.
John Jones [3] (son of Thomas [2] and Mary (Rowzie) Jones and brother of the above Thomas, William, Suca, Mary and Robert Jones) in his will dated 9 January 1759 (Essex County  Will Book #11, page 178) states: to my niece Mary [4] Jones all my land in Essex County, Virginia; to my niece Elizabeth Upshaw [4] ----; to my nephews James [4] and Jeremiah [4] Upshaw ----; to my two nephews Thomas [4] and William [4] Sthreshly ----; to my cousin Elizabeth Jones daughter of James [2] Jones ----; to my sister Betty Garnett ----; to my sister Suca Upshaw ----; to my God-daughter Milley Garnett ----; to my brother James Garnett ----; to my friend Muscoe Garnett ----; to my Aunt Martha Sale ----. ; Witnessed by James Garnett, William Thomas, Jr. and Betty Jones. Probated 15 May 1759.  Executors William Garnett, Muscoe Garnett and James Upshaw.   Codieil -- Mary Jones, daughter of my brother William deceased - land to remain in hands of executors until Mary is 21 or marry.
Robert [2] (who predeceased his father William Jones of livel dated October 19, 1743) died intestate before 20 October 1730, when Elizabeth Jones, relict of Robert Jones, with John Edmondson, James Jones and John Rowzee as her securities, was appointed administrix of the estate of Robert Jones, deceased. Bond was foi the sum of 4,000 pounds current money and made out to the Gentlemen Justices of Essex County among which were William Daingerfield, James Garnett and Thomas Stheshley Jr.  (Essex County Will Book #4, page 395.)  We do not know how old Robert was at the  time of his death or whether he died suddenly or after a long illness.  Did  he have only the two daughters widely separated in age, or had he had other children who had died, perhaps from the same illness that caused his death?  Was Elizabeth the mother of all his children or just of Sarah, his youngest?
The first record we find of Robert is as Under Sheriff of Essex County, Virginia.  on 7 February 1710, he bought 737 acres in Essex County adjoining land of  Salvator  Muscoe.  (Essex County Book D and C #13, page 376.)  on 10 December 1712 Elizabeth Jones, Ri chord Anderson and Salvator  Muscoe witnessed a deed from James Halloway of St. Anne's Parish Essex County, planter to Nathaniel Ffogg of the same Parish, Innholder.  On 2 May 1713 he was granted 274 acres in Essex County by Lieutenant General Sir Alexander Spotswood.  On 20 January 1713/14 Elizabeth Jones witnessed the will of William Dier on 11 March 1713/14 Robert Jones was security for John Dyer (son of William) as executor. onl1Febuimy 1713/14 Agnes Butler, wife to John Butler, relinquished her dower ; rights by Robert Jones, her attorney.    On ll June 1717 Rotat Jones bought from William Moss 386 acres, where the widow Martha Moss dwells,  adjoining Robert Brooke, William Jones, Cornelius Sale and Joshua Stepp in Essex County.  Witnessed by Thomas and John Jones. (Book D and W #15, page 70.)  On 17 March 1723 he bought 400 acres from Richard Moss of Westmoreland County, Virginia, adjoining land of William Jones, Cornelius Sale and Robert Brook, on fork of Little Occupacia Creek. (Deed Book #17, page 295, Essex County).
Robert Jones and William Daingerfield represented Essex county in the 9 May 1723 Session of the Virginia House of Burgesses and again in the 12 May 1726 session. But only Dainger field is recorded as present at the 1 February 1727/8 Session.  Session records for 1727 through 1792 period are so fragmentary that it is not possible to tell how long he served.  we here unable to find any record of the death of Robert Jones. However a highly respected genealogist and historian wrote, ''Robert Jones departed this life 30 August 1730 in Essex County Virginia."  I do not know where he found this.  on 14 November 1730 (Will Book #4, pages 404 through 407) the inventory of Robert Jones, Deceased, was returned to Court by Elizabeth Jones, Adm'x and had been taken by James Alderson, Cornelius Sale and Robert Parker.  This inventory showed 21 negroes, 8 horses, 17 cattle, 37 sheep, hogs, farming tools, household goods, Books of Divinity) 3 pocket books, parcel of Law  Books, etc.  On 9 October 1732 an addition to the above inventory was recorded (Essex County Will Book #5, page 114).  We do not know the maiden name of Elizabeth, widow of Robert Jones.  Of her securities, James Jones was her husband's brother, and John Edmondson and John Rowzee were probably her brothers or brothers-in-law.  Robert Jones left only two children, Elizabeth and Sarah Jones.
Elizabeth Jones, the eldest daughter, married first John Boulware (also spelled Bowler )aud after his death, she married second Anthony Garnett, eldest son of Thomas Garnett, all of Essex County, Virginia.  John  Boulware probably died shortly after marriage and they had No children.  Robert [4] Garnett was the eldest son of Anthony and Elizabeth [3] [Jones] Garnett.  Their other children were Thomas, James, John, Reuben, Lucy, Elizabeth and Sarah Garnett.  The younger daughter Sarah Jones married John Elliott of Westmoreland County, Virginia, and their eldest son was William [4] Elliot, of whom we will see later.
Anthony and Elizabeth [3] (Jones) Garnett were married before 20 August l733.  See ''Release of Dover Rights of Elizabeth, wife to Anthony Garnett and widow of John Bowler, to Susannah Bowler, sister of John, dated 20 August l733.  (Essex County Deed Book #20, page 15.)
On September 1735, Anthony Garnett and Elizabeth his wife, one of the daughters of Robert Jones deceased, petitioned the Court to divide his lands between Elizabeth and her sister Sarah and set off the Widow's Dower and that the Court appoint George Stubblefield to be guardian of said Sarah who is still an infant (under 14).  (Essex County, Virginia, Order Book #9, page 128.)  In deeds dated 16 November 1742 and 17 May 1743 John Elliott and Sarah firs wife of Westmoreland County, one of the daughters of Robert Jones, deceased, sold some of the loud in Essex County that Robert Jones had bought.  (Essex County Deed Books #22, page 419, and F'23, page 10.)
The will of Cornelius Sale (son-in-law of William [1] Jones) of Essex County dated 3 April 1745 and proved 17 Mardi 1746/7 (Essex County Will Book #7, page 501 through 504) states: to my grandson William Sale one half of the land where my son William lived, purchased of Augustine Smith, and one half to my daughter-in-law Hannah Blackbourne during her life and after her decease to my grandson William Sale; to my son Anthony Sale five pou nds; to my son John fall all lands I purchased of Major Robert Brooke firth all the part whereon I now live that lies on the west of the main road that leads from Garnett's Mill to the Range; to my sone Cornelius Sale all lands I bought of Francis Pagit and Daniel Tucker and all other lands not before bequeathed, after my wife's decease.  But if Cornelius Should die without issue all said lands to my son Thomas, but if he die without issue to my son John.  My son Thomas Sale to hour use of my dwelling plantation with lands I bought of Tucker for ten years after my wife 's death.  To my son James Sale three negroes, to my daughter Hannah Sorrill and five pounds, to my daughter Elizabeth farmer one negro and five pounds, to my granddaughter Mary Fisher five pounds when she comes of age or marry.  Sons John Sale and Thomas Sale to be executors.  Witnessed by J. Garnett, John Loyde and Robert Smith.
Proof that John [2] and Thomas [2] Jones were sons of William [1] Jones is in the 1759 will of John [3] Jones (son of Thomas [2]).  In his will he mentions his brothers, sisters, nieces, nephews, Uncle James Jones and Aunt Martha Sale.  Comparing these four wills, William [1], John [2], Thomas [2], and John [3] proms their relationship.  The will of John [3] Jones oo 1759 also begins the proof that Robert [2] Jones (father of Elizabeth [3] [Jones ] Garnett) was a son of William [1] Jones (of will of 1743) by stating, ''to my niece Mary Jones."  Sonic his only brother that lived past childhood was William, Mary Jones had to be William's daughter.  a deposition by zon Sale, Senior, was taken about 20 September 1792 in behalf of Robert [4] Garnett and William [4] Elliott, co- heirs and co-partners Plaintiff in a suit in King and Queen Courty , Virginia, against Robert Bayley, John Hipkins And Charles Thornton.  King and Queen County records of this period have been destroyed, but a copy of this deposition and other papers regarding this suit were in  the Hipkinfours s, Bernard, Robb family papers deposited in the E.G. Swim Library, Williamburg, Virginia.  This deposition Of John Sale , Senior, aged about 75 years, taken at his dwelling house, states that Robert Garnett is the eldest son of Anthony Garnett and Elizabeth, his wife whose maiden name was Jones and was the daughter of Robert Jones, which said Robert Jones was the uncle of William Jones who was the father of Mary Jones who married Charles Thornton under whom the Defendants claim.
The foregoing proves conclusively, I believe, that Robert Jones (father Of Elizabeth [Jones] Garnett) was a son of William Jones of  Will of 1743.  My wife and I searched the Essex County, Virginia, records in 1967 and 1969, but a copy of the above deposition did not reach us until after 1973, so not knowing that William was the ancestor, we had made no attempt to find the parents of William Jones.  Perhaps in the future, someone may do this. Also, perhaps someone will research the maiden name of Elizabeth, wife of William Jones and Elizabeth, wife of Robert Jones. By George B. Loeffler, Sr.* May 27, 1981
*In May, 1986, George Loeffler passed away (see "Death").  Mr. Loeffler was a noted genealogist who, with his wife, conducted research into some of the Willis-Gordon-Garnett kin.  We shall miss Mr. Loeffler's accurate and detailed research.
The name Saile or Sale is the same, and has been spelled as it was found in each of the old documents. Since each document had its own separate spelling,  we have chosen to follow the  spelling as chosen in the original document.
The "highly respected genealogist and historian" is George H.S. King.  Some years ago he wrote to Mrs. Day of Tulia, Texas, and sent her the information regarding the suit by Robert Garnett and William Elliott against Robert Bayley, John Hipkins and Charles Thornton in King and Queen County, Virginia.  The deposition by John Sale (in this suit) completed  Mr. Loeffler's proof that Roberts Jones was a son of William Jones.  Also in that (or other correspondence) with Mrs. Day, Mr. King states ''Robert Jones departed this life 30 August 17 30 in Essex County, Virginia."
Mr. Loeffler wrote Mr. King and asked his permission to give credit for this work.  Mr. King requested that we not give credit since he feared  he would be inundated with requests for genealogical information.  However, since this article was written Mr. King has died. therefore, credit for his work is appropriate.
