      Research Notes
      In 1600 the freeholders in Winstanley were James Bankes, Edmund Atherton, and James Winstanley of Blackley Hurst. [1]

      "A settlement of lands in Billinge was made in 1596, Humphrey Atherton and Alice his wife, and Edmund, the son and heir, being deforciants; Pal. of Lanc. Feet of F. bdle. 59, m. 21. Edmund Atherton of Winstanley died in 1613 holding land in Billinge of the Baron of Newton; Humphrey his son and heir was four years old; Lancs. Inq. p.m. (Rec. Soc. Lancs. and Ches.), i, 277. From deeds in the possession of W. Farrer it appears that Romeshaw House was part of the Atherton estate."[1]

      Note
      Spelling of his name varies-Edmond and Edmund.

      Edmund's will names his wife Elizabeth and his brother-in-law, Roger Molineaux as his executors, inferring that his wife was Elizabeth Molineaux. Some argue that his wife was Mary Rudd but there is no evidence to support this claim.

      I have been researching the Atherton family of Winstanley, Lancashire and indeed have a transcript of Edmond's Will Dated 8th April 1613, [probated in Chester in 1614] which I think will help correct some of the errors made on his profile. Following transcribed by Allan Bond.


      In the name of God amen the 8th daie of Aprill Ano 1613, I Edmund Atherton of Winstanley in the Countie of Lancaster Gentleman, beinge sicke in bodye and yet of good and perfecte memorie, thanks be to God, Therefore doe ordaine and make this my last Will and Testament in manner and forme followinge.

      That is to say first I commend my soule in to the handes of Almightie God steedfastly trustinge to be saved by the effection of Christ by his bloode and my bodie to be buryed att Upholland. Item I give and bequeath to Elizabeth my wiffe and to my three daughters Anne, Margaret and Elizabeth all my goodes and chattles moveable and non moveable quicke and deade wherein I have any intereste rights and title to the value of one pense ov'r and above the discharginge of my debtes hereafter named and my funerall expenses payed. Allsoe my will and mynd is that soe same at my house in Winstanley hath discharged such of my debts for p'mt Richard Atherton doth stande bounde for that, then my said wiffe Elizabeth shall have use and enjoye all the said house soley for her self duringe her natural lyffe and after her decease then my will and mynd is that my sonne Humphrey shall have the same and that is conferred, Thereof he shall yearly paye to my afforesaide three daughters Anne, Margaret and Elizabeth if they be then lyvinge or to such of them, He shall then surplye the sume of ten poundes of lawfull English money and if it happen the said Humphrey be deceased then my mynd and will is that said three daughters shall have and enjoye the afforesaide house duringe the residue of my lease. Item I doe ordayne and make my lawfull Executors of this my last Will and Testament my well beloved wyffe Elizabeth and my trusted friend and lovinge brother-in-law Roger Molineux,

      Memorandum to Will Edmund Atherton 1613

      Memorandum tht the said Edmund Atherton after the wrytinge and publishinge of his Will above said, did further by wordes nuncupative w’thout wrytinge declare and announce that it was not his mynd and will that his three daughters nor any of theme should have any more money or profitts pertaining out of the tenement in Winstanley than to each of his daughters ten poundes (of lawfull money of England) W’ch was, vizt to Anne Atherton his daughter ten poundes to Margaret Atherton ten poundes and to Elizabeth Atherton his daughter ten poundes and that his said sonne Homffrey shoulde pay the saide thirtie poundes as afforesaid within three yeares next after that the said Homffrey should enter of the said house, by ten poundes a yeare. And further it was the will and mynd of the said Edmund Atherton that if any of the said three daughters did decease before the said payemnts are made that then the remaining daughters to have and enjoye the said xxx£s. And that the said sonne Homffrey shall not be burdened with the payments of any more money in any xxxx to be paid to the said daughters nor any of theme out of the said rente. xxx xxxx.
