Benjamin and his brother, Charles Needham joined the 31st Regiment, Company 'K', Alabama Volunteers. His last payment, according to the National Archives in Washington, DC, was on 30 Jun 1865 for $20.66. After his captured at Big Shanty, Georgia, Benjamin served the Union Army under the command of Captain Nathorne. The Union Army listed his occupation as farmer, his age at twenty, with green eyes, dark hair, dark complexion, and a height of 5'9".

BEN M. DAY PASSES AWAY
Funeral services for Ben M. Day, 88, early pioneer of this city and a Civil war veteran, who died in Yakima at six o'clock Wednesday evening will be held at two o'clock Saturday in Henry Dunham's undertaking chapel in this city. Interment in the local cemetery will follow.
Benjamin Day was a native of Alabama, and came to Skagit county in 1888. He was accompanied to Mount Vernon by his wife and seven children. One daughter, Mrs. Kate Boone of Portland, Oregon, was born after the family moved to this city.
Throughout a long period of forty-four years, Mr. Day made his home in this city, although he was frequently away from here at various times. After the death of his wife, more than twenty years ago, he shared the homes of different members of his family.
Two sons, William Day and Sylvester Day, are buried in the local cemetery in the family plot where his wife is resting.
Surviving of his immeditate family are six children, Mrs. W.S. Anable of Yakima, in whose home Mr. Day died; C.P. Day of Cedardale, Mrs. L.F. Taggert of Seattle, B.F. Day of Wenatchee, Mrs. George Sidney of British Columbia and Mrs. Katie Boone of Portland.
Mrs. Boone will arrive here tomorrow and the remains are expected here tonight.
