·Ä¢I Sion Coates of Dist,of Kershaw and State of S.C. calling to mind the uncertainty of life do make and publish this my last will and testament in a manner and form following Viz,
Item 1st-I give and devise to my son Sion Coates in fee simple, all that parcel of land purchased by me from Gilliam Clanton situate in Dist, of Kershaw on the drains of Singleton Creek also all land I own that lays between the road passing Liberty Hill to Camden the land belonging to John Clanton, the land now claimed by Dempsey Graham and a line running from N.E. corner of a tract originally granted to Thomas Mageekee to a stake corner of said land thence continuing the course of said line a crop a tract of land originally granted to William Kirkland to a tract of land originally granted to James Perry now in possession of Dempsey Graham. I also give and bequeath to my said son Sion Coats one negro man Bob.
Item 2nd- I give and devise to my two sons Gideon Coates and John Coates in fee simple all that tract of parcel of land on which my dwelling house is situated composed of parts of several surveys being all the land I now own that lies between John Clantons land Austin F. Peays land the land in possession of Dempsey Graham and the land above designated and devised to my son Sion Coates to be equally divided between my sons, Gideon Coates and John Coates. I also devise to my son Gideon Coates one Negro man named Joe and a young mare of name Printers Filly and one featherbed and furniture. I also bequeath to my son John Coates one colt by name of the Kupiosco Colt also one featherbed and furniture.
Item 3rd- I give and bequeath to my daughter Betsy Coates two of my slaves Viz Eliza and Hariotte and a mare known by name of Virginian Filly and a featherbed and furniture.
Item 4th- I give and bequeath two of my slaves Viz Amy, and Reuben, a horse called John in trust to my wife, Sarah Coates for use of my daughter Jincey Revell during her natural life and at her death to the heirs of her body forever. The earnings of said negro slaves and horse is not subject to the control of her husband or liable for any of his debts.
Items 5th- I give and bequeath to my daughter Mary Coates two of my slaves Viz Chainey and Diner also one featherbed and furniture.
Items 6th- I give and bequeath to my daughter Rebecca Coates three of my slaves Viz Mathew, Venus, Jackson also one featherbed and furniture.
Items 7th- I give and devise to my wife Sarah Coates during her natural life three of my slaves Viz Hannah, Ferriby and Jim and two of my horses, also all my stock of cattle and hogs my plantation tools and also my wagon and gear and kitchen furniture and my household furniture in this item of my will, to be equqlly divided among all of her children or such of them ae she the Sarah Coates may direct.
Items 8th- I further will and direct that a piece or parcel of land lying on the N.E. side of the road passing Liberty Hill to Camden and adjoining Joseph Cunninghams land and near to his dwelling house to be sold by Executors herin after named in such manner as shall appear to them for the interest of my estate and the proceeds there of applied in the first plan to the purchase of a negro for my son John Coates, the boy to be of a good size for a plough boy the balance arising from sales of this land, if and balance to be applied to the payments of my debts.
Items 9th- I will and bequeath to my daughter Polly Flanigan two hundred dollars to be paid her by my Executors hereafter named after the proceeds of the crops raised at the expiration of three years from the time of my death.
Items 10th- I also will and direct as a further means for the payment of my debts that the whole of my land devised to my children( except land devised to my son Sion Coates) all my slaves horses stock household furniture wagons plantation ect, bequeathed to my wife and children (except Negro slave to my son Sion Coates)remain in the hands and under management of the Executors for three years or until profits and earnings thereof together with monies to be raised by sales of land shall enable them to pay off and discharge any debts, the legacy to my daughter Polly Flanigan and negro boy for my son John and until the devices and legacies to be delivered up to wife and children and with a reasonable allowance for the schooling of my three youngest to be such as I have given my other children.
Items 11th- I do hearby authorize my Executors here after named to renwe regularly and keep up my notes in any and each of the banks according to the rules and regulations of said banks until they can pay off and satisfy and discharge the same monies of my Estate.
Item 12th-Lastly I nominate constitute and appoint my wife Sarah as my Executrix my son Sion Coates and friend Austin F. Peay Executors of my last will and testment, In witness whereof I have here unto set my hand and seal this twenty seventh day of March in year of our lord One thousand eight hundred and thirty in the 54th year of American Independance.
Signed sealed published and delivered by said testator who signed this sheet as his last will and testament in presence of us who at his request in the presence of each other have subscribed our names as witness due executor thereof.
