At the Police Court to-day Angus Calder was committed for trial under the Infants Act, regarding the death of a boy,Trevor Calder, aged seven years: —(1) That between January and March, 1916, when the child was four years of age, he ill-treated him in a manner likely to cause unnecessary suffering by frequently and repeatedly dipping him into a bath of cold water and holding him in the water; and (2) that he ill-treated the child in the same way when six years of age, between October, 1918, and June, 1919. It was alleged that owing to the ill-treatment the child had run away from home, and when found was in an emaciated condition and with his feet severely frost-bitten. He was admitted to the hospital on7th June and died on the 16th from tetanus and heart failure. The eleven-year-old brother of deceased gave evidence that shortly after Trevor's return from his grandparents he was ducked by his father. The bath was usually about half-full, and the water was sometimes warm and sometimes cold. ... About a month before he died his father threatened to dip him, and he ran away. ... The hearing of the charges against Angus Calder, of Mangere (Mr. A. Moody) in respect to the death of his seven-year old son Trevor, was concluded before Mr. Justice Chapman at the Supreme Court yesterday. The jury, after a retirement of over two hours, returned a verdict of not guilty on the manslaughter charge and guilty of the two minor charges of wilful ill-treatment, with a strong recommendation to mercy. A sentence of four months' imprisonment with hard labour was imposed. The boy ran away from his home at Mangere in June last,due, according to the contention of the Crown, to the fear of punishment at the hands of his father. When found, several days later, he was in such a condition that he had to be sent to hospital. He later contracted tetanus and died. It was stated that this was the third time the boy had run away from home. The accused was charged that between January and March, 1916, when the boy was four years of age he wilfully illtreated him and caused him to be exposed to unnecessary suffering or injury to his health. There was a second charge of a similar nature, the period being between October, 1918, and June, 1919, and a third charge of manslaughter. The Crown Prosecutor, the Hon. J. A. Tola, K.C., represented the Crown.
