Richard "settled a considerable jointure" on Mary, including Underriver House and lands, but died on 26 October 1722 "after a very severe illness which deprived him of memory, without issue". He was buried "in linnen (sic)" at Seal Parish Church on 1st November 1722. His will was dated 22nd October 1722, 2 days before he died. His will was proved on 8th January 1724 with Sara Goodhugh named as executrix - presumably his mother, as his sister had been married to Daniel Woodgate for 20 years. His bequests were "I will devise and give unto my loving wife Mary all that my messuage wherein I now dwell at Underriver and all lands and tenements by me settled on her before marriage for her jointure" He then further names a fairly extensive list of other properties in Kent, Sussex and Surrey, including "all lands used by my Brother Mr. Daniel Woodgate (ie brother in law); also "Watts Cross Lands...my messuage Farm and lands at Rooks Hill in the occupation of John Dane. ...and also all my lands called Levett Lands" all "...unto the said Mary my wife and to her heirs and assigns forever" Source: Grizelda Barton
