    Thomas WARREN was married three times. The name of his first wife and the date of her death is unknown. This second wife was Mrs. Elizabeth SHEPARD, widow of Maj. Robert SHEPARD and daughter of William SPENCER, Member of the House of Burgesses, 1624.

    A marriage contract between ?Mr. Thomas WARREN of Smith's Fort, Surry, Gent. And Mrs. Elizabeth SHEPARD, widow, of Lower Chippoakes?, was made 23 Sep 1654. This document states that Thomas WARREN is to have and enjoy all the estate of Maj. Robert SHEPARD, dec'd, now in possession of the said Elizabeth his relict, except the land and the following articles which Mrs. Elizabeth shall dispose of at her own pleasure, viz; one gold seal ring marked D.S., one pair of silver tongs marked R.S., one silver ink horn marked I.S., and she may appoint feofees in trust to oversee her children's estate and it is agreed that on 29 Sep 1656, Mr. Thomas WARREN shall give to Anne, John, Robert, and William SHEPARD certain horses and sums; and to Priscilla and Susanna SHEPARD their full share of their father's estate, besides give each a cow and calf, etc. This contract was recorded 9 Nov 1654, after the marriage. The witnesses were Edward FFOLIOTT and William COCKERHAM. The feofees appointed for the children were Mr. John COCKER, (p. 246) Mr. William COCKERHAM, Mr. FFOLIOTT and MR. CAULFIELD.

    Thomas WARREN's 2nd wife, Elizabeth (SPENCER) SHEPARD died before 1659 as Thomas WARREN, Jr., eldest son of third wife, was born in that year. His third wife was Jane, widow of John KING, who married thirdly, Samuel PLAW.

    Thomas WARREN made his Will 16 Mar 1669, and same was probated 21 Apr 1670, by his son William. If the will was recorded in Surry the recording has been lost.

    Children by First Wife:
    1. William, granted probate of his father's will 21 Apr 1670, was dead before 24 Sep 1670. Dsp.
    2. Alice, aged 32 in 1677 (Deposition) married Matthias MARRIOTT. This is proven by the following agreement dated 24 Sep 1670. (Bk 1, p.377)
    ?An agreement between Jane WARREN, relict of Mr. Thomas WARREN, dec'd, late of Surry Co., of the one part, and Matthias MARRIOTT who hath married Alice WARREN, the only sister of the whole bloode of William WARREN, deceased, son of the aforesaid Mr. Thomas WARREN, of the other part, witnesseth: That said Jane WARREN and Matthias MARRIOTT are and have been at controversy and variance about the division of the aforesaid Thomas and William WARREN, their estates: Now to the end that perpetual partition shall be had and made between said parties of and in the aforesaid Thomas and William, their estates, both personal and real, it is covenanted, concluded and agreed between the said parties to those presents in manner and form following: first that Mrs. Jane WARREN shall have her thirds out of the whole estate of the above said Mr. Thomas WARREN, his estate, and if Thomas WARREN, son of the above said Mr. Thomas WARREN, and Jane his wife, should happen to die before he comes to the age of 21 years, that the land which was given to him by his father's will is then to fall to William WARREN, the youngest son of said Thomas WARREN and Jane his wife, during his natural life, and when he dies said land is to fall to Matthias MARRIOTT and his heirs forever. It is also agreed that Thomas, a negro man, is and shall remain Matthias MARRIOTT's and his heirs forever, said Matthias MARRIOTT paying unto the above said Jane WARREN the sum of 1667 lbs of legal tobacco and casks out of his share of the estate and likewise it is further agreed between said parties that said Matthias MARRIOTT shall have a white mare and her foal, one feather bed and furniture, one gold ring and one caster hat, all of (p.247) which were the estate of William WARREN, and that the above said Matthias MARRIOTT shall have a full share of with the children out of the abovesaid Thomas WARREN, deceased, his estate, and that the manour house wherein said Thomas WARREN did live and the whole devident of land whereon it is situated with all houses, orchards and other appurtenances thereunto belonging is and shall remain in fee simple unto Matthias MARRIOTT and his heirs forever; it is further agreed betwixt said parties that said Jane WARREN shall peaceably and quietly use, occupy and enjoy the one-third of the aforesaid manour house and of all other houses, orchards and the devident of land thereunto belonging with free egress and regress in and upon said land during her life, said MARRIOTT to have him his share of the crop 2 bushels of wheat and 2 bushels of oats. In witness whereof the parties above specified have hereunto set their hands and seals the day and year above written.?

    In 1672 Mr. MARRIOTT was fined for contempt of the county court as shown by the following order:
    ?Atte a courte houlden at Southwarke for the county of Surry the 4th day of September 1672?Mathias MARRIOTT haveinge in Contempt of an order of this Courte, grounded upon an Act of Assembly for the restraint of servaunts waliing abrode on Sundayes or other dayes, gave his Negroe a note to goe abrode & having noe business; and alsoe rederinge scurrilous language to the Court both yesterday and todaye; the said MARRIOTT is ordered to pay unto the sheriffs for use of the county, Two Hundred Poundes of Tabacco & Caske with Costs?? (V.7 -314)

    On 23 Jul 1673, Mathias and Alice MARRIOT sold a tract of land ?on which they now live? to John SALWAY, ??same formerly in possession of Mr. Thomas WARREN commonly called 'Smith's Fort' being 400 acres on Gray's Creek, adjacent William MARRIOTT's land lying on south side of James River?. (RB 1671-84, p. 30)

    This was a deed to the present ?Warren House? which became Mathias' under the above prenuptial agreement. It came to Alice upon the death of her brother William WARREN in 1670.

    In consideration for the above property, John SALWAY (p. 248) and his wife Elizabeth deeded to Mathias MARRIOT a tract of land lying at the head of Grey's Creek 'nigh unto the church.' ( RB 1671-84, p. 31)

    Alice MARRIOT made a deposition 15 Sep 1677, in which she stated she was aged ?32 or thereabouts?.

    Mathias MARRIOTT's Will was dated 12 Jun 1707 and probated 2 Sep 1707. He gave his wife, Alice, the manor plantation for her life, at her death to go to son William. He mentions daughters Margaret FLAKE, Elizabeth HILL, Marion CHIPS, granson Thomas FLAKE, son of Robert FLAKE. (RB 1694-1708, p. 374)

    William MARRIOTT was an only son and as he was named executor, he was therefore probably a minor when his father's will was written in 1707 but he proved a document under oath in 1710 and most have been of legal age at that time. It was appear that he was born about 1688.

    William MARRIOTT was married before 16 Nov 1725, as he was joined by his wife Sarah COLLIER in making a deed of that date. Their marriage and her identity are further evidenced by the will of her father Thomas COLLIER, dated 15 Feb 1728, ??my Daughter Sarah MARRIOTT, wife of William MARRIOTT, my Grandaughter Mary MARRIOTT, my Grandsons William and Thomas MARRIOTT?their father, my son-in-law William MARRIOTT.?

    ?Major William MARRIOTT?, who was obviously a kinsman and at various times was a member of the Surry Court, High Sheriff of the County, and Vestryman of Southwarke Parish had an only surviving child, Mary, married to Mr. Samuel THOMPSON who, in his will written in 1720, bequeathed to William, son of Mathias MARRIOTT, ?my seal ring that was my wife's father's ring.?

    In his will, dated 20 Sep 1765, and proved 20 Jan 1767, William MARRIOTT did not mention his wife, who must have died before the will was written. The major part of this property, including land in Brunswick Co., VA, was left to his sons Thomas and Mathias, and to John and William, sons of his deceased son Benjamin MARRIOTT. A bequest of land in Brunswick was made to William MARRIOTT's grandson, William DAVIS, his -son-in-law Henry DAVIS was given negroes and other personal property; and their was provision for ?the maintenance and education of my daughter Mary DAVIS' five Smallest Children?. (1754-1768, p.436) He also provided that Stephenson BUXTON and his wife Elizabeth enjoy the dwelling ?where they now live? until his grandson William MARRIOTT was 18.

    It is possible that Elizabeth BUXTON was William MARRIOTT's sister. Mary MARRIOTT, only daughter of William MARRIOTT, married Henry DAVIS. (See later).

    III. Elizabeth, m. John HUNNICUTT. The marriage contract between the two was dated 26 Feb 1670/71 (D&W 1644-71, p.38) John HUNNICUTT also receipted Mathias MARRIOTT for the estate of his wife, Elizabeth, daughter of Thomas WARREN, dec'd. (Do, p.389). John HUNNICUTT died intestate in 1699. His inventory, signed by Elizabeth HUNNYCUTT, his wife, was dated 17 Apr 1699. This tithables for 1702 show the names of William, John, and Thomas HUNNICUTT as tithables in her household and over 16, thus indicating them as sons.

    VI. Robert, b. 1667, d. 1721 On 29 Sep 1688, he made a deed to John WATKINS of ?100 acres of land, part of 450 acres granted my father, Mr. Thomas WARREN, 1 Nov 1669, who did by his last will and testament give and bequeath same to me.? (Bk. 4, p.89) He also on 5 Jan 1690, deeded Luke MEIZELE 350 acres - wife Anne relinquished her dower. Admin. Of his estate was granted to Robert WARREN, probably a son, 15 May 1628. (Bk. 7, p.810)
    VII. William, b. 1669/70, d. 1702. He receipted his brother Thomas for his share of father's estate, 15214 lbs of tobacco, 25 Apr 1691.
    Administration on his estate was granted to James WARREN, probably his son, 2 Jun 1702. (Descendents untraced.)

    2. Thomas WARREN, Jr. was born 9 Jan 1659, which is proven by the following order dated 4 Jun 1680: ?Thomas WARREN, son of Thomas WARREN, will be of age on the 9th day of this instant. Samuel PLAW is to deliver him his part of his father's estate on the 15th of this month?. (O.B. 1671-90, p.329)
    The Court also ordered Samuel PLAW to give him the shares of the three other orphans of Mr. Thomas WARREN.

    On 20 Apr, 1684, Francis Lord HOWARD, Governor, granted Thomas WARREN, ?280 acres of land situated about a mile and half above Ware Neck Mill in the Upper Parish of Surry Co., 190 (p.250) acres thereof being part of a patent of 290 acres granted his father Mr. Thomas WARREN, deed 3 Jul 1648, the remaining 90 acres being waste land.? (PB 7, p.367)

    Thomas WARREN'S Will was probated 16 Aug 1721 (Bk 5, p. 362) His wife was Elizabeth, who made her will in 1724, same probated 1730. She names the four sons named in her husband's will, and in addition - grandson Thomas WARREN, granddaughter Mary WARREN, grandson James DAVIS. (Bk. 8, p.80).

    II. John, ?land called 'Rich Neck' where he now lives?.
    III. Joseph, ?land lying upon Peterfells and Buck Point, between Hog Pen Swamp and Wild Swamp, 90 acres.?
    IV. Robert, ?land between Hull Cabins and Shee Cabins, 40 acres.?
