Sir James succeeded his childless and insane uncle as 3rd Lord Livingston of Callendar in 1497.
He married circa 1472 to Beatrice Fleming, daughter of Robert, the 1st Lord Fleming and granddaughter of Sir Malcolm Fleming of Cumbernauld who had been executed following the Black Dinner of 1440. Beatrice Fleming was a great X4 granddaughter of Robert the Bruce (1274 - 1329), King of Scotland (1306 - 1329)

From The Livingstons of Callendar, etc. by Edwin Brockholst Livingston 1920: His prececesser, the 2nd Lord, in a claim before the Lords in Council in May 1498, is described as being his 'eme', namely uncle. This claim arose out of a dispute concerning the 3rd lord's title to the lands of Castletoun and Balmalloch in the barony of Kilsyth, which was challenged by William Livinston of Kilsyth as the son and heir of the late occupier, Edward Livingston of Balcastle. This suit resulted in an agreement by the terms of which it was arranged that Lord Livingston should have the lands in heritage, and William Livingston of Kilsyth in feu-ferme from him. Lord James was knighted before July 30, 1477, and he is styled Sir James Livingston of Lethbert on Aug. 4, 1488. In June 1495 the tenants of Wester Whitburn complained in parliament against Sir James for taking their cattle. The Lords ordained him to restore the oxen and cows as good as they were, or pay the value; the value is specified, a cow and an ox, four merks, three oxen, six merks. He must have experienced a delay in obtaining his inheritance as on Dec. 7, 1497 he had to pay to the Lord High Treasure the following feudal fine for non-entry: 'Item, the vij day of Dec. (1497) I resauit fra Schir James of Levingstoun, Lord of the Kalendar, of ane termez male of his landis, being in the Kingis handis for his nonentree, jclxvjli. xiijs. iiijd.' During the following year, as Lord Livingston, he obtained sasine of the family estates; and on Jan. 30, 1499-1500, King James IV, confirmed to him and Agnes Houston, his spouse, on his own resignation for conjunet infeftment, and to their legitimate issue, the lands of Slamannan Mure and Terrintirran in Kippen, in the barony of Callendar. This lady, who was the daughter of John Houston of that ilk, he had married previous to June 1491 was his 2nd wife. On June 2, 1512 Robert Callandar of the Maner, received a grant, under the Privy Seal, 'of the gift of the marriage of the air-male of umquhile James Lord Levinstoun gottin betuix him and Agnes Houstoun quhilk sall succeid to thair heretage.' and also on Dec. 10 of same year of the non-entry of th elands of Terrintirran: the 'heretage' being the lands contained in the above charter of Jan 30, 1499-1500, and which lands were inherited by their son Alexander Livingston of Terrintirran. Lord Livingston's first wife was Beatrice, or Elizabeth, Fleming, daughter of Robert, first Lord Fleming, whose eldest son Malcolm had married Lord Livingston's aunt Euphemia Livingston. There seems to have been some scandal connected with this marriage, for on the first of Nov. 1472, 'a noble man, James of Livingston, son of quondam Alexander of Livingston, deceased,' appeared in the presence of witnesses before the high altar of the parish church of Kirkintilloch, and there solemnly declared that of his own accord he had contracted matrimony with a noble young lady (domicella) Beatrice Fleming, 'daughter of a noble and potent lord, Robert, Lord Fleming,' and he 'gave his great oath' that if he had not contracted matrimony (legally) with her, he would do so 'de novo.' One of the witnesses present at this ceremony was James of Livingston's kinsman Edward Livingston of Balcastle. The son (William) of this marriage succeeded to the title and Callendar estates.
