``The last Will and Testament of me, THOMAS PESTELL of Mepsall Chapel in the parish of Mepsall otherwise Meppershall in the Counties of Hertford and Bedford, yeoman, as follows: that is to say, first I give and devise to my loving WIFE ANN PESTELL and her assigns for and during the term of her natural life all that my Freehold Messuage or Tenement with all the lands and grounds thereto belonging which I purchased of Matthew Lary, and from and after the decease of my said wife, I give and devise the said Messuage or Tenement, lands and premises with all the hereditaments nd appurtenances thereunto belonging to my SON JOHN PESTELL, his heirs and assigns for ever; also I give and bequeath to my said wife all the Goods, Bedding and Furniture belonging to my best Lodging room, and the sum of twenty pounds of lawful money of Great Britain, to be delivered and paid to her within one Month next after my decease by my Executor hereinafter named; also I give and devise to my said son John Pestell all and singular my other Messuages, Cottages, lands, Tenements, hereditaments and real estate whatsoever and wheresover that I shall die possessed of, interested in or entitled unto, either in possession, remainder or expectancy, to hold to my said son John Pestell, his heirs and assigns forever, but subject and charged as hereinafter mentioned, that is to say, as to, for or concerning such parts of my said real estate as descended to me as Heir at Law of my late FATHER THOMAS PESTELL deceased, or was or were devised to me in or by his last Will and Testament, subject in the first place to all such charges and outgoings as in and by my said father'b4s will are charged thereon; also I do give, devise and bequeath unto my said wife and her assigns, for and during the term of her life, an annuity, yearly Rent charge or sum of twenty pounds of lawful money of Great Britain, to be yearly issuing out of and chargeable upon all and singular my said Messuages, lands, tenements, hereditaments and real estate (except for the said Messuage or Tenement and premises hereinbefore by me devised to my said wife for the term of her life, which is not intended to be charged with the payment of any of the annuities or other payments charged on my said real estate), during my said wife'b4s life only, and to be paid to my said wife or her assigns clear of all Parliamentary Taxes and all other taxes, charges and deductions whatsoever, by even and equal payments on four of the most usual feasts or days of payment in the year, that is to say, Lady Day, Midsummer Day, Michaelmas Day and Christmas Day, the first payment whereof to begin and be made on such of the said feast days or Days of Payment as shall first and next happen after my decease, and I do hereby further devise that in case the said annuity or yearly rent charge, or any part thereof, shall happen to be behind and unpaid by the space of twenty days hereinbefore appointed for payment thereof, then and so often it shall and may be lawful to and for my said wife and her assigns into and upon the said premises charged therewith, or any part thereof, to enter and distrain, and the Distress and Distressed then and there found from time to time to take, seize, sell and dispose of in the nature and as a distress for Rent, may or can by Law be taken, sold and disposed of by and out of such distress and distresses from time to time, to raise and detain all arrears of the said annuity and all costs of charges; SON THOMAS PESTELL, one weekly payment or sum of four shillings; to my DAUGHTER ANN, the WIFE OF JOHN BELL, £100, and to my DAUGHTER MARY, the WIFE OF WILLIAM LYLES, £5, and to THOMAS and EVANS, the children of my son Thomas, £50 each; to the SIX CHILDREN of my DAUGHTER SARAH SUTTON £20 apiece; to the FOUR CHILDREN of my DAUGHTER ANN BELL, £30 each; to the THREE CHILDREN of my DAUGHTER MARY LYLES, £100 between them; annuity to my Mother as per my father'b4s will; residue to son John, who is sole Executor; signed 27 June 1780:- Thomas Pestell; wintnesses: Thomas Evans; Law[rence] Times; John Wells; proved at London, 7 February 1785; John Pestell sworn
