A VERY SAD CASE.
At South Melbourne court yesterday, Richard Boote, who had been on remand at the Gaol Hospital was charged with threatening the life of his wife.
Mr. Rogers, for the complainant, said the object of the prosecution was to have accused placed under restraint, as he was not responsible for his actions at times.
Rose Boote, wife of accused, said she and accused had been married for 10 years, and had lived very happily together until latterly, when her husband began to develop occasional fits of temporary insanity. Then he gave vent to violent outbursts of passion. On 14th October he seized a small axe and said he would put an end to her. In his sane moments he was the kindest of husbands; but since he had been suffering from pains in the head his
mental affliction became so frequent that she was positively afraid to live with him.
Accused, who had the appearance of a man of weak intellect, made a pathetic statement, to the effect that he had no wilful intention of killing his wife, and he had no recollection of using abusive language towards her. He was very fond of her, and wished to make his home a happy one.
Inquiries had shown that both parties were thoroughly respectable, and the husband was not addicted to drink.
The Chairman (Mr. Jones, J. P.) said that under the present charge, accused could not be sent to gaol and it would be security to the wife to bind him over to keep the peace. The proper course would be to deal with him under the lunacy laws.
Mr. Rogers concurred with the bench, and an adjournment was made until 2 p.m., for the purpose of securing the attendance of two medical men.
On the court resuming at 2 o'clock, the bench, on the evidence of Drs. Kenny arid Kitchen, committed the unhappy husband to the Kew Asylum.
