Notities over WILLIAM W. Mitchell SR.

William W. Mitchell, Sr. was born March 6/7, 1806 in Indiana Territory, Fayetteville Precinct, now St. Clair Co., IL.  He was the son of Peter Mitchell/Mischler, Jr. and Hannah Teter. He died March 9, 1858 and is buried in the Baldwin Cemetery in Randolph Co., Illinois.

The following was found among Probate Papers of Peter Mitchell, dec'd.:
"Recd. of Isaac & William Mitchell by the hands of George Mitchell, sixty two and a half cents in full of the subscription of Peter Mitchell, decd. to the St. Clair Gazette for three monthly.  August 21, 1834; R. K. Fleming." (Proof that William's father was Peter Mitchell, and that Isaac and George were his brothers. CJH)

William Mitchell, 1 male, age 5-10; 1 male, age 30-40; 3 females, under 5 years of age; 2 females, age 5-10; 1 female, age 20-30.

It is hard to tell in which county William W. Mitchell died; according to Estate Probate Papers he had land in Randolph and St. Clair Counties. He married his 2nd wife in Kaskaskia (recorded in Randolph Co.) and married his 3rd and 4th wives in St. Clair Co. He is found in the 1850 census (#641-654) in Randolph Co. (T4S,R7W) and he died in 1858 intestate; his probate was settled in St. Clair Co., IL.

William W. Mitchell married 1st an unknown lady by whom he had a son, William W. Mitchell, Jr. We do not know exactly how many wives William had, but, there must have been at least four.

William W. Mitchell's 2nd wife is believed to have been Christiann/Christian Redpath, born January 8, 1807; they married, March 3, 1831, in Kaskaskia, IL; she died March 25, 1835. Date of her death was not very long before William married his third wife.

*WILLIAM W. MITCHELL married 3rd, April 19, 1836, *REBECCA TETER, born January 16, 1805 in Indiana Territory, Fayetteville Precinct, now St. Clair Co., IL. She was the first female child born in the area. Rebecca died July 10, 1843. She was the daughter of Abraham Teter, Sr. and Maria "Mary" Kittle. Abraham was the brother of William's mother, Hannah Teter Mitchell and therefore, Rebecca was William's cousin.

William W. Mitchell married 4th, June 12, 1845, Nancy Jane Lively, born about 1826 and died about September 14/15, 1860 when a claim was presented for her coffin. In the Baldwin Cemetery, where we believe that William is buried next to his son, John, there is a grave on the other side of John; it is of a James LIVELY. He was of an age with Nancy Jane.  Was he her brother? We do not know.

Four graves found:  In the late 1970's or early 1980's we went to the Randolph Co., IL Courthouse looking for evidence of the death of William W. MITCHELL and any information we could find about his children.  We found records of the death of his son, James R. MITCHELL, who died April 11, 1888 in Baldwin and was buried in the Baldwin Cemetery. This was the only record we could find. We left the Courthouse and went to the Baldwin Cemetery. We did not find his or his wife's graves but we did find the grave of their son, William Adam MITCHELL, born August 4, 1860 and died December 28, 1866. We believe that James and his wife are also buried here although there are no tombstones for them.

Searching further, we found three tombstones:  One broken stone laid up against a tree, the name missing, but, it had the date of death, March 9, 1858, age 52yrs., 3 days.  The tombstone, next to the broken stone on the grave, was of a John Mitchell, born July 27, 1851 and died December 15, 1867. At this time we had no information about a John Mitchell. Next to him, on the third stone was the name James Lively, died November 26, 1869, age 36yrs., 11mos.  We knew that William W. Mitchell had been born about 1807, and was in the 1850 census, but not the census of 1860, of Randolph Co., IL. His youngest daughter, Isabell, was born in 1858 and so we figured he had died 1857-1860. We felt at the time that the broken stone was possibly the tombstone of William W. Mitchell but had no proof nor knew of a connection with either John Mitchell or James Lively, but we noted this find and put it away for future reference.

Many years later, in the early 1990's, we found, in microfilm records of the Belleville "Democrat" Newspaper, a notice that was to be inserted for 3 weeks, starting May 23, 1862, stating that on the 4th Monday in June 1862 Isaac Johnston was resigning the guardianship of Isaac Mitchell, William Mitchell, John Mitchell, Amos Mitchell and Isabel Mitchell, the minor heirs of William Mitchell, dec'd. Isaac, William and Isabel are listed in "The Teter-Kittle-Mitchell-Hill" Bible and were the children of William W. Mitchell. We didn"t know who John and Amos Mitchell were! We had not looked at the above record of tombstones we had found in Baldwin Cemetery, for many years and missed the connection. ; We were not able to find, in the Probated and Non-Probated Will Indexes of either Randolph or St. Clair Co., any record of a will of William Mitchell and felt he must have died Intestate.  In about 1996, we again went to the Courthouses in Randolph and St. Clair Counties. We did not find anything in Randolph Co., but hit pay dirt in St. Clair Co. We made copies of some of the Probate Records of William W. Mitchell and Guardianship Records of some of his minor heirs. We went through them at home and they raised many more questions. We remembered that we had been told that the IRAD (Illinois Regional Archives Depository) at Southern Illinois University in Carbondale, IL, 62901, had Probate and Guardianship records that they would be willing to search for us and make copies of the microfilmed records. We received about 120 copies. They were wonderful!  The following is the basis for the birth and death dates, as well as most of the information we have for William W. Mitchell, Sr., Isaac, James, William, Jr., John, Amos, and Isabell Mitchell, the minor heirs of William, and his 4th wife, Nancy Jane Lively Mitchell Rauch.

1.    1 March 1858.  A claim was submitted dated 30 July 1858 of a bill for purchases
        from 7 April 1857 to 1 March 1858.  William Mitchell was still alive at this time on
        1 March 1858.

2.    8 March 1858.  Date of this claim is not readable. In the body of the claim it is stated
        that William Mitchell had bought rails on 8 March 1858; claim was paid 11 May 1858.

        8 March 1858 - 11 March 1858.  The last date is of the following record of
        renunciation by Nancy Jane Mitchell and the other heirs in relinquishing their rights
        to administer the estate of William Mitchell. (William W. Mitchell died the 9 March
        1858; see Baldwin Cemetery in these records.

3.   11 March 1858.  Renunciation of Widow & heirs Wm. Mitchell, dec'd. Signed 13
        March 1858:

        "11 March 1858.  To the County Clerk of St. Clair County  This is to certify that I
        Nancy J. Mitchell the widow of William Mitchell dec'd do relinquish my wright to
        administer on the said Estate and wish you to grant letters of administration to
        Samuel Stookey of said County witnesseth my hand

4.    June 1858.  Nancy Mitchell signed a receipt for having received from Samuel
        Stookey Administrator of William Mitchell dec'd. $223.00 due to her in lieu of
        Separate property assigned her as widow of said deceased.

5.    8 April 1860.  Final Settlement of Estate of William Mitchell dec'd. Samuel Stookey
        administrator. - Line No. 39, Nancy Mitchell settlement, $223.00 - Line No. 40,
        coffin, $6.00 (William's coffin; no record of claim has been found) - Line No. 48,
        James Mitchell settlement, $490.00. William Mitchell's daughters, Mary an Mitchell
        Adkins Stephens and Hannah Emaline Mitchell Hill (married Peter Hill, 1859), must
        have received their share as a dowry when they married(?); I have not found any
        record of their having received an inheritance in the Estate and Probate Records.
        William Mitchell may have had Hannah's dowry set aside for her for when she
        married and therefore it was not included in the records. It may have been given to
        their husbands.

6.    23 April 1860.  William H. Bennett was appointed by the Courts as guardian of the
        following minor heirs of William W. Mitchell, dec'd.: Isaac Mitchell, William
        Mitchell, John Mitchell, Amos Mitchell, Isabel Mitchell.

          ;    Isaac        as a minor aged  13 years on the 12    day of June          A.D. 1860
          ;    William    as a minor aged  11 years on the   1    day of August      A.D. 1860
          ;    John      ;   as a minor aged   9 years on the 27th day of July           A.D. 1860
          ;    Amos      ;  as a minor aged   6 years on the 28th day of January     A.D. 1860
          ;    Isabell      as a minor aged   3 years on the   4th day of March       A.D. 1860

7.    15 September 1860.  Claim submitted for a coffin, $14.00. In the body of the claim it
        also gives the date of sale of the coffin as 15 September 1860. It was paid 27 April
        1862* to Jacob Skaer(?). Probably for Nancy Jane Lively Mitchell Rauch. The claim
        is difficult to read, "Sept. 15, 1860 ____ one? coffin & B__ coffin lined(?).  The
        price of a coffin is usually only $7.00.  If there were two coffins, *Amos' coffin may
        have been included under this date.  Amos died about 21 Nov. 1861. A Coffin for
        Amos has not been found in settlement records of the estate. Amos was still alive on
        the date this claim was submitted as he is included in the guardianship records of
        Isaac Johnston who was appointed his guardian on 27 February 1861.

8.    22 February 1861.  Isaac Johnston was appointed by the Courts as guardian of the
        following minor heirs of William W. Mitchell, dec'd.: Isaac Mitchell, William
        Mitchell, John Mitchell, Amos Mitchell and Isabell Mitchell.

9.    7 April 1861.  Claim submitted against the estate of Mrs. Mitchell, dec'd.: claim was
        paid 22 May 1862.

10.   25 April 1862.  One claim against the Estate of Nancy Jane Rauch, dec'd. and a
        receipt of ; payment of a claim.

        22 May 1862.  Claim was paid for by Isaac Johnston as guardian of the minor heirs
        of William Mitchell, dec'd.  Receipt was for the payment of a claim. It was paid by
        Isaac Johnston as guardian of the minor heirs of Nancy Jane Rauch, dec'd.

        Therefore, Nancy Jane Rauch was Nancy Jane Lively Mitchell; she must have
        married Louis Rauch about 1859/60. Although the age given in the 1860 U.S.
        Census was 20 yrs. of age, and she was actually 34yrs. of age, all the minor heirs of
        William Mitchell, dec'd., except William, were in this household.

        Nancy Jane Lively Mitchell Rauch died 14/15 September 1860.

11.   23 May 1862.  Isaac Johnston placed a notice in the Belleville “Democrat”
        newspaper for three weeks starting 23 May 1862 stating that on the fourth
        Monday in June 1862 he was resigning the guardianship of Isaac Mitchell, William
        Mitchell, John Mitchell, Amos Mitchell and Isabel Mitchell, minor heirs of William
        Mitchell, dec’d.

12.   23 June 1862.  Isaac Johnston submitted his Resignation, Distribution and Final
        Settlement as Guardian of the minor heirs of Wm Mitchell, dec’d. As Executor
        of the Estate of Wm H. Bennett, Isaac Johnston swore to give a true account
        & statement of the affairs of the minor heirs of Wm Mitchell, dec’d. of when Wm H.
        Bennett, dec’d. was Guardian to the best of his knowledge.  The Distribution of the
        sums available for distribution shows the following:  At bottom of settlement record,
        it has “5 heirs due Each $125.04.

13.   23 June 1862.  Settlement of Boarding and Clothing Account for the minor heirs
          ;                      of William Mitchell, dec’d.:

        11 March 1861.  Receipt for the boarding and clothing of Amos Mitchell for
          ;                         $40.00.  Signed by L. T. McGuire.

        18 November 1861.  Receipt for William, John, Amos, and Isabelle Mitchell for
          ;                                boarding & clothing, $8.00. signed by Milbrey Tayler.
        This amount of $8.00 was divided by the 4 heirs in the settlement of the estate.  Each
        heir paying $2.00; this must have been only for clothing and was taken out of an
        account for boarding & clothing.

        21 November 1861.  Receipt for the boarding and clothing of Amos Mitchell,
          ;                                $20.00.  Signed by L. T. McGuire.

        L. T. McGuire must have been given the care of Amos Mitchell while he was alive.

        Boarding and clothing was mostly for Amos Mitchell.  He may have died about
        21 November 1861 and therefore they were presenting their claims against
        William Mitchell’s estate for the care of Amos.  The second receipt was included
        in the settlement of each of the minor heirs of William Mitchell dec’d., $2.00 each
        went to Milbrey Tayler; the first and third receipts were included in only Amos’
        settlement, $60.00 to L. T. McGuire.  The actual dates of the payment for which
        each receipt was given is not shown.

14.   23 June 1862.  Isaac Johnston, as guardian of the minor heirs of William Mitchell,
        Final Settlement Records listed 5 heirs:  Isaac Mitchell, balance due was $727.20;
        John Mitchell, balance due was $722.59; Isabelle Mitchell, balance due $723.46;
        William Mitchell, balance due $726.??; Amos Mitchell, dec’d., $666.9?.

        Amos Mitchell probably died about 21 November 1861.

15.   23 June 1862.  Petition of PETER HILL in the matter of the estate of Wm Mitchell
        deceased, for Letter of Guardianship.

        Peter Hill ask to be made the guardian of Isabelle Mitchell.

        "The Petition of the undersigned Peter Hill respectfully represents that Isabelle
        Mitchell is a minor aged 5 years on the 9 day of March A.D. 1862.....that said minor
        has property to the amount of about $1,000.00.....and that your petitioner is the
        Brother in Law and desires to be appointed guardian of said minor June 23rd 1862         ;                                                 ; Peter Hill"

16.   17 July 1862.  Petition of William Baumann in the matter of the Estate of
        Wm Mitchell deceased, for Letter of Guardianship.

        William Baumann ask to be made the guardian of William and John Mitchell.
        Guardian had died and the minor heirs had property worth about $2,000.00.

        We have not found in the Guardianship Records an appointment of a guardian
        for Isaac Mitchell, minor heir of William Mitchell, dec’d.  He may have been given
        his inheritance and since he was fifteen years of age he may have chosen to stay in
        the home he had with Louis Rauch.  The court felt he didn’t need a guardian?

17.   31 December 1867.  In Estate Records of William W. Mitchell, dec’d., we found
        a claim presented which reads as follows:

          ;   "Risdon, Ill.  Dec. 31. A.D. 1867.
          ;   Received of David Whitchurch $7.00 for John Mitchell coffin.
          ;                                       John M. ?Steininger"

        This coffin was for John Mitchell minor heir of William W. Mitchell, dec’d., who
        died 15 Dec. 1867.  (See Page 2 - Graves Found at Baldwin Cemetery).

18.  13 June 1868.  Final Settlement.  William Baumann guardian in account with John
        Mitchell a minor.....being dead.  31 Dec. 1867, coffin $7.00 with interest $.20.
        Amount of Final settlement of Estate of John Mitchell, dec’d. being $1020.76.

19.   8 November 1870.  An official form letter was filed informing William Baumann,
        guardian of William Mitchell, a minor heir of William Mitchell deceased, that
        William Mitchell, his ward, had chosen Peter Hill to be appointed his Guardian in
        place of William Baumann and that he was to appear before the County Court of
        St. Clair County, on Wednesday the 23rd of November 1870, at the Courthouse in
        Belleville then and there to make settlement as guardian and show cause if any why
        he should not be removed from his office of guardian and Letters of Guardianship be
        given to Peter Hill.

20.   23 November 1870.  2nd Final Settlement, William Mitchell, ward of William
        Baumann, $1485.95.

21.   3 August 1871.  Court Order to William Baumann late Guardian of William
        Mitchell, Ward, "to show cause why he should not pay unto Peter Hill the present
        guardian of William Mitchell, Ward.  Otherwise an attachment will be filed against
        him."

22.   12 August 1871.  William Baumann Guardian in account with William Mitchell
        ward.  Additional Settlement the 12th day of August 1871. Balance due ward was
        $1546.94.

Found among these records was a record listing a tombstone.  It had no names or dates that were distinguishable.

Above guardianship records show that Isabell was age 3 on the 4th March 1860.  When Peter Hill ask for the guardianship of Isabell, he stated that she was 5 years of age on the 9th day of March 1862.  The Bible of (Hannah) Emaline Mitchell Hill, half-sister of Isabell and wife of Peter HILL, has Isabelle Mitchell as having been born on 8 March 1858.  Peter and Emaline Mitchell Hill raised Isabell and became the Guardians of her brother, William W. Mitchell, Jr.  Would the Bible date then be more accurate?  The Bible birth dates for Isaac and William agree with the above records.  The minor children, John and Amos Mitchell are not listed in the Bible.

These records have filled in a great many gaps in our knowledge of William W. Mitchell, his wife, Nancy Jane Lively Mitchell (Rauch), and their children. We believe the above records prove that John and Amos were the children of William W. Mitchell and Nancy Jane Lively Mitchell (Rauch) and that they both died young.

From the different records of Claims made against the Estate, I estimated that William W. Mitchell, Sr. must have died between 8 March 1858 and 11 March 1858.  Therefore, the grave, with the broken tombstone, that was next to John Mitchell's tombstone, at the Baldwin Cemetery, must be the grave of John’s father, William Mitchell, Sr.  The broken tombstone had the date of death as 9 March 1858, age 52yrs., 3 days, therefore, born about 6/7 March 1806.  William, Sr. was born about 1807 according to the 1850 U.S. Census of Randolph Co., IL. The pieces of broken tombstone were gone the last time we visited the cemetery.

"Notice is hereby given to all persons interested that on the fourth Monday of June, A.D. 1862, I will resign my office as guardian for Isaac Mitchell, William Mitchell, John Mitchell, Amos Mitchell, and Isabell Mitchell minor heirs of William Mitchell, dec. myself (?) or (My 5 or May S or May I?) (Signed) Isaac Johnston."
